Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Nach Vorlage der EP zur Prüfung beim AG (I.NA-SO-N-LPZ-P) wurde im Ergebnis die zusätzliche Planung der Baufreiheitsmaßnahmen für des Gewerk LST in EP-Tiefe gefordert. Im Zuge der Planung wurde festgestellt, dass am Bauwerk EÜ Olbitzbach (FFH- Gebiet) ein neuer Biberdamm errichtet wurde. Da dieser geschützt ist, muss die Bauwerksvariante / Herstellungstechnologie geändert werden. Durch die Änderung der Umbautechnologie werden die Baufreiheitsmaßnahmen erforderlich. Der Gesamtcharakter des Auftrages bleibt unverändert.
