Wenn der Zuschlag bereits wirksam erteilt worden ist, kann dieser nicht mehr vor der Vergabekammerangegriffen werden (§ 168 Abs. 2, S1 GWB)

Die Zuschlagserteilung ist möglich, 10 Kalendertage nach Absendung der Bekanntgabe derVergabeentscheidung per Fax oder Email, bzw. 15 Kalendertage nach Absendung der Bekanntgabe derVergabeentscheidung per Post. (§ 134 Abs. 2 GWB)

Die Zulässigkeit eines Nachprüfungsantrags setzt ferner voraus, das die geltend gemachten Vergabeverstößeinnerhalb von 10 Kalendertagen nach Kenntnis bzw.

— soweit die Vergabeverstöße aus der Bekanntmachung oder den Vergabeunterlagen erkennbar sind,

— bis zum Ablauf der Teilnahme – bzw. Angebotsfrist gerügt wurden (§ 160 Abs. 3 S1 Nr. 1-3 GWB). EinNachprüfungsantrag ist ebenfalls unzulässig, soweit mehr als 15 Kalendertage nach Eingang der Mitteilung desAG, einer Rüge nicht abhelfen zu wollen vergangen sind (§ 160 Abs. 3 S.1 Nr. 4 GWB). Des Weiteren wird aufdie im § 135 Abs. 2 GWB genannten Fristen verwiesen.

An den Signalen 24Vp3, 24N2, 24VWn2, 24P3 und 24Vn12 ist ein zusätzlicher Schutzkorb erforderlich, da der Mindestabstand zur Oberleitung von 1,5m unterschritten wird.
