Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

MKA14:

Zur Sicherstellung der Einhaltung der Richtlinien zum Schall- und Erschütterungsschutz sowie zum Immissionsschutz sind für die

Lph. 3/4 detaillierte Schall- und Erschütterungstechnische Untersuchungen während der Bauphase und während des Betriebs

sowie Immissionstechnische Untersuchungen notwendig.

Auf Grund der bestehenden vertieften Projektkenntnisse des Generalplaners ist aus Sicht der Projektleitung der AN mit diesen

Leistungen über Nachtrag zu beauftragen. Weiterhin kann das Projekt durch den Verzicht auf eine komplett neue Einarbeitung

eines weiteren Planungsbüros Synergieeffekte nutzen und damit die entstehenden Planungskosten wirtschaftlich halten.

Eine komplett neue Einarbeitung eines weiteren Planungsbüros und der damit entstehenden Schnittstellen wäre mit erheblichen

zusätzlichen Planungskosten und nicht kompensierbaren zeitlichen Verschiebungen im Projekt verbunden.
