         Gegenstand dieser Ausschreibung ist die Beauftragung eines Unternehmens mit der Errichtung und dem Betrieb einer Breitbandinfrastruktur der nächsten Generation ("NGA-Netz") in den noch unterversorgten Gewerbegebieten der Stadt Hamm. Das zu errichtende NGA-Netz muss eine Versorgung der im Ausbaugebiet ausgewiesenen Gewerbeadressen mit einer Bandbreite von mindestens 1 Gbit/s symmetrisch gewährleisten.

         Das durchgeführte Markterkundungsverfahren bestätigte, dass die Errichtung und der Betrieb eines solchen NGA-Netzes im Ausbaugebiet nicht eigenwirtschaftlich abbildbar sind. Aus diesem Grund ist der Auftraggeber bereit, dem privaten Telekommunikationsunternehmen einen einmaligen, nicht rückzahlbaren Investitionszuschuss zur Deckung seiner Wirtschaftlichkeitslücke zur Verfügung zu stellen (sog. "Wirtschaftlichkeitslückenmodell").

         Zum Nachweis der beruflichen Befähigung hat der Bewerber unter Verwendung des Formblatts Teilnahmeantrag (Formblatt: E.1) folgende Angaben und Eigenerklärungen abzugeben:

         - Firmenprofil des Bewerbers unter Angabe des Gründungsjahrs, der Gesellschaftsform sowie der Anzahl sozialversicherungspflichtiger Arbeitnehmer;

         - Meldebestätigung nach § 5 Telekommunikationsgesetz (TKG); sowie

         - Auszug aus dem Berufs- oder Handelsregister.

      2. Economic and financial standing:

         Zum Nachweis der wirtschaftlichen und finanziellen Leistungsfähigkeit hat der Bewerber unter Verwendung des Formblatts Teilnahmeantrag (Formblatt: E.1) folgende Eigenerklärungen abzugeben und Nachweise einzureichen:

         - Eigenerklärung des Bewerbers über den Gesamtumsatz des Unternehmens in den letzten drei abgeschlossenen Geschäftsjahren;

         - Nachweis einer aktuell gültigen Betriebshaftpflichtversicherung oder einer vergleichbaren marktüblichen Versicherung mit einer Mindestdeckungshöhe über EUR 1 Mio. für Personenschäden und über EUR 3 Mio. für Sachschäden (z.B. Kopie der Police), die als Jahresversi-cherung geführt und über die gesamte Laufzeit des Vertrages aufrechterhalten wird.

         Die vorbezeichnete Betriebshaftpflichtversicherung ist bei einem in einem Mitgliedstadt der EU oder eines Vertragsstaates des Abkommens über den Europäischen Wirtschaftsraum zugelassenen Ver-sicherungsunternehmen zu führen. Die Deckung muss über die Vertragslaufzeit uneingeschränkt erhalten bleiben.

         Die Deckungssummen müssen je Versicherungsfall zur Verfügung stehen, wobei die Gesamtleistung des Versicherers für alle Versicherungsfälle eines Versicherungsjahres maximal auf das Dop-pelte der Deckungssumme begrenzt sein darf (sogenannte 2-fache Maximierung). Bei Versicherungsverträgen mit Pauschaldeckung (also ohne Unterscheidung nach Sach- und Personenschäden) ist eine Erklärung des Versicherungsunternehmens erforderlich, dass beide Schadenskategorien im Auftragsfall parallel zueinander mit den geforderten Deckungssummen abgesichert sind.
