Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Die Grundlagenermittlung (Lph. 1) sowie die Vorplanung (Lph. 2) der Baustraße in der Falkenbrunnstraße sollen zusätzlich erstellt

werden. Das Tiefbauamts fordert, dass die Bestandsstraße in Ihrem Zustand erhalten bleiben muss. Hieraus folgt, dass die Falkenbrunnstraße

ertüchtigt werden muss, um sie als Baustraße verwenden zu können. Der bisherige Auftrag beinhaltet diese Leistungsbild nicht. Durch einen

AN Wechsel würden Synergieeffekte durch einheitliche Leistungserbringung verloren gehen und es würden erhebliche Verzögerungen im

Planungsablauf eintreten. Bei einer erneuten Vergabe würden beträchtliche Zusatzkosten für die Planung entstehen, weil honorarmindernde

Faktoren bei einer getrennten Vergabe nicht in Ansatz gebrach werden können.
