Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Entgegen der ursprünglichen Annahme und Ausschreibungsmodalität, befinden sich in bestehenden Kabelkanälen, in Teilbereichen mehr als die in der Leistungsbeschreibung genannten 5 Kabel, die bauzeitlich umgelegt und gesichert werden müssen. Diese zusätzlichen Kabel müssen ebenfalls umgelegt und gesichert werden, damit der Bau-AN seine Vertragsleistung erbringen kann. Es ist nicht umsetzbar, dass der beauftragte AN lediglich die vereinbarten 5 Kabel umverlegt und sichert und ein weiterer AN dann die identische Leistung für die weiteren Kabel, die nur in Teilbereichen vorhanden sind, vornimmt. Da es sich hierbei um eine reine Zulageleistung handelt, würde eine anderweitige Vergab dieser Leistung zu erheblichen Zusatzkosten führen, da bestehende Synergien nicht genutzt werden könnten.
