Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Der AN ist gem. LV mit der Errichtung des KTB beauftragt. Um im Bereich der Strecke 6088 km 20,858 - km 21,016 den Kabeltiefbau herstellen zu können, ist hierfür eine Randwegkonstruktion mit einem Geländer und der Rückverankerung zu planen und auszuführen sowie die bautechnische Prüfung der Ausführungsunterlagen durchzuführen. Sämtliche v.g. Mehraufwendungen sind im Vertrag nicht enthalten und somit als zusätzliche Leistungen zu betrachten. Eine weitere Firma für diese Leistung zu binden, würde erhöhte Personalkosten und einen erhöhten zeitlichen Aufwand bedeuten. Zudem würde es zu Verzögerungen im Projekt führen, die an anderer Stelle bis zur Inbetriebnahme nicht kompensierbar sind.Die Beauftragung von weiteren Unternehmen würde zu einem Verzug innerhalb des Leistungsablaufs, zu erheblichen Zusatzkosten und weiteren Beeinträchtigungen an von diesem Teilprojekt zusammenhängenden Leistungen führen.
