l"Avenant a fixé le prix unitaire hors taxe des mi-chaussettes polyamide blanches indépendamment de la formule de révision des prix.

la période couverte par cette modification, court à compter de la notification de l"avenant jusqu"au terme de l"accord-cadre, soit le 26 novembre 2023.

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

fin octobre 2022,le titulaire a déposé une demande indemnitaire auprès de la plate-forme commissariat Rambouillet (Pfc-Rbt) afin de compenser la perte subit lors de l"exécution de l"accord-cadre relatif à la fabrication de mi- chaussettes polyamide blanches suite à la conjoncture économique actuelle.

En effet, la très forte hausse des prix et des composants ainsi que les difficultés d"approvisionnement de certaines matières premières, consécutives notamment à la relance économique après la crise du covid-19 puis à la guerre en Ukraine, ont entraîné une augmentation significative des coûts de production.

Lors de la passation de l"accord-cadre, ce contexte n"existait pas et était imprévisible. Par conséquent, le mécanisme de révision des prix prévu par le cahier des clauses administratives particulières (Ccap) ne permettait pas d"absorber l"augmentation inflationniste actuelle des coûts de production.
