         Oikeuskäytännön mukaan häviösähkön hankinnassa on kysymys erityisalojen hankintalain 6 §:n 6 momentissa tarkoitetusta energiahuoltoon liittyvästä energian hankkimisesta, eikä se näin ollen kuulu erityisalojen hankintalain tai hankintalain soveltamisalan piiriin. Sähkömarkkinalain 23 §:n mukaan verkonhaltijan on kuitenkin hankittava sähköverkkonsa häviöenergia avointen, syrjimättömien ja markkinapohjaisten menettelyjen mukaisesti. Täyttääkseen edellä mainitut sähkömarkkinalain mukaiset edellytykset hankintayksikkö julkaisee hankinnasta hankintailmoituksen.
