        The Agreement on the Danish Financial Act for 2022 introduced a new market based subsidy fund (the “NECCSFund”) of DKK 2,609,400,000.00 (2023 prices), to achieve negative CO2 emissions by permanently and geologically storing biogenic or atmospheric CO2 (NECCS). The fund is scheduled for disbursement between 2025-2032. The granting of subsidy under the NECCS Fund is encompassed by the European Commission’s Guidelines on State aid for climate, environmental protection and energy 2022. The designation of the Contract(s) as a service contract in the contract notice, section II.1.3), etc. does not change this. The competitive bidding process is conducted as an open procedure in accordance with the general principles of the Danish PublicProcurement Act.

      2. Other additional information

        The DEA has decided to extend the deadline for submission of offers from December 1, 2023, to January 15, 2024. The expected contract signing date is postponed from February 29 to March 15, 2024. The postponement occurs partly due to a necessary update of the tender material and partly because the EU Commission"s state aid approval for the NECCS fund unexpectedly has not yet been granted.

        Given the timeline of the tender procedure, the DEA considered at the time of publication of the tender documents the likelihood of CCS in 2024 to be very limited. The DEA still considers this to be an unrealistic prospect and the DEA has received no indications that there are any market actors capable of achieving capture and storage CO2 already in 2024. It has been decided that the amount of 50,200,000 originally allocated for 2024 shall be removed from the NECCS fund. Accordingly, the total maximum available subsidy of the tender procedure has been adjusted. Further reference is made to the updated tender documents and the information, including Q and A published in the electronic tendering system.
