3、Qualification Requirements For Bidder
Qualifications or Performance:3.1.1 The Bidder shall be an independent legal person or other organization in compliance with the Bidding and Tendering Law of the People"s Republic of China. Domestic bidders shall provide business license or legal entity certificate; overseas bidders shall provide local business registration documents.
3.1.2 Provide the original or copy of credit certificate issued by the Bidder"s opening bank within three months prior to the bid opening date.
3.1.3 The Bidder shall undertake that the export of equipment and software fully complies with relevant international and Chinese laws and regulations, and shall assist in completing all necessary import and export approval and licensing procedures.
3.1.4 For domestic products, only manufacturers are eligible to bid.For overseas products, both manufacturers and authorized agents are acceptable.If the Bidder acts as an agent, a valid official authorization letter issued by the original manufacturer shall be provided; the original manufacturer and its agent shall not participate in the same tender simultaneously.
Overseas suppliers shall quote only on DAP terms; suppliers within China customs territory shall quote only on DDP terms.If an overseas supplier intends to bid via an agent, the agent shall also be an overseas enterprise and quote only on DAP terms.Any bidder providing goods and services from outside China customs territory shall be capable of signing foreign trade contracts directly with the Tenderer or its authorized foreign trade agent.
3.1.5 Joint bidding is not accepted in this project.
3.1.6 If awarded, the successful Bidder shall sign formal written contract strictly in accordance with the tender documents and its bid proposal, and shall not add any unreasonable clauses or impose additional requirements on the Tenderer.
3.1.7 Within the recent one year, the Bidder and the manufacturer of the tendered products shall have no major illegal records in business activities, no illegal bid winning by unfair competition means, no major economic criminal cases, and no contract termination or losing lawsuit as the defendant caused by breach of contract, violation of laws or business ethics. A self-drafted commitment letter shall be submitted.
3.1.8 Performance RequirementBidders shall provide sales performance evidences to prove that the global sales volume of the same brand and same model original equipment is no less than 8 sets from January 1, 2023 to the present (calculated by contract signing date).The submission shall clearly indicate equipment sales date, customer name (can be replaced by code) and order quantity.
During bidding, key pages of purchase order, sales contract or user acceptance certificate shall be attached.Note: Demo equipment and undelivered PO equipment shall not be counted into the above quantity.
The bidding documents shall be attached with a written commitment: All above information is true and accurate; we shall bear corresponding legal liabilities if any inconsistency with facts. The commitment shall be signed by authorized representative and affixed with the Bidder"s official seal. The Tenderer reserves the right to verify the original performance documents when necessary. Besides, the Bidder shall submit a performance authenticity commitment letter in the format specified in tender documents.
3.1.9 The Bidder shall submit an Enterprise Basic Information Form, covering enterprise nature, registration information, business scope, relevant industry qualification certificates (copy acceptable) and other supporting documents to prove its capability for this tender. The form shall be sealed with official seal to ensure authenticity and accuracy.
