3、Qualification Requirements For Bidder
Qualifications or Performance:1) The bidder shall be an independent legal entity or other organization that complies with the provisions of the "Bidding and Tendering Law of the People"s Republic of China" (domestic bidders shall provide a business license or legal person certificate, while foreign bidders shall provide local registration documents);
2) The original or copy of the credit certificate issued by the bidder"s account-opening bank within three months prior to the bid opening date;
3) The bidder shall commit to ensuring that the export of its equipment and software fully complies with relevant international and Chinese laws and regulations, and assist in obtaining all necessary import and export licensing procedures. (Provide a written statement in the format of Appendix 6-7.)
4) For domestic products, this project only accepts bids from product manufacturers. For overseas products, bids are accepted from both manufacturers and agents. If the bidder is an agent of the product, a valid authorization letter issued by the manufacturer of the selected goods must be obtained and provided. The manufacturer and its agent cannot participate in the bidding simultaneously. (Refer to Appendix 6-5 for the authorization letter issued by the manufacturer.)
5) Suppliers outside the customs territory can only provide quotations in DAP terms, while suppliers within the customs territory can only provide quotations in DDP terms. If suppliers outside the customs territory require a bidding agency, the agency must be a company outside the customs territory and can only provide quotations in DAP terms. Bidders providing goods and services from outside the Chinese customs territory must possess the capability to directly sign foreign trade contracts with the tenderer or its entrusted foreign trade agency.
6) If the bidder wins the bid, a written contract shall be concluded in accordance with the bidding documents and the winning bidder"s bid documents, without adding any other unreasonable terms or imposing additional requirements on the tenderer. (Provide a written statement in the format specified in Appendix 6-7.)
7) The bidder and the manufacturer of the bid goods have no major illegal records in business activities within the past year, have not engaged in unfair competition practices to secure the bid, have not been involved in major economic or criminal cases, and have not led to contract termination or adverse judgments as a defendant due to any breach, violation of law, or breach of business ethics by themselves. (Provide a written statement in the format of Attachment 6-7)
8) The bidding equipment provided by the bidder shall be a brand-new product. (Provide a written statement in the format specified in Appendix 6-7.)
9) Performance Requirement: The supplier must provide sales records of original equipment of the same brand and type with a market sales volume ≥【10】 units from January 1, 2023, to the present (based on the contract signing date), including the equipment sales dates, corresponding customer names (customer names can be replaced with codes), and order quantities. During the bidding phase, procurement orders, procurement contracts, or user acceptance certificates, including key information pages, must be submitted. The submitted materials must include a relevant commitment stating, "The above information is true and reliable. If it does not match the actual situation, the supplier shall bear legal responsibility," along with the signature of an authorized representative and the company seal of the bidder. The tendering party reserves the right to verify the original sales performance documentation when necessary. (In addition to the aforementioned supporting documents, the bidder must provide a letter of commitment on the authenticity of performance in the format specified in Appendix 6-9 of the tender documents.) Note: This performance figure shall not include demo units or PO unshipped equipment.
