3、Qualification Requirements For Bidder
Qualifications or Performance:The Bidder shall be an independent legal person or other organization in compliance with the provisions of the Bidding and Tendering Law of the People"s Republic of China. Domestic bidders shall provide a business license or legal person certificate, and overseas bidders shall provide local registration documents.The original or copy of the credit certificate issued by the bidder"s opening bank within three months prior to the bid opening date.The Bidder shall undertake that the export of its equipment and software fully complies with relevant international and Chinese laws and regulations, and shall assist in completing all necessary import and export licensing procedures.For domestic products, only bids from product manufacturers are acceptable for this project. For overseas products, bids from both manufacturers and agents are acceptable. If the bidder is an agent of the tendered products, it shall obtain and provide a valid authorization letter issued by the manufacturer of the tendered goods, and the original manufacturer and its agent shall not participate in the bidding simultaneously. Overseas suppliers shall quote only on a DAP basis, while domestic suppliers within the customs territory of China shall quote only on a DDP basis. Where an overseas supplier intends to bid through an agent, the agent must be an overseas enterprise and shall quote only on a DAP basis. Bidders providing goods and services from outside the customs territory of China shall be capable of signing foreign trade contracts directly with the tenderer or its authorized foreign trade agent.Consortium bids are not acceptable for this project.If the bidder is awarded the bid, it shall sign a written contract in accordance with the tender documents and its bid documents, and shall not add any unreasonable clauses or put forward additional requirements on the tenderer.The bidder and the manufacturer of the tendered goods have no major illegal records in business activities within the past year, have never obtained bid awards by unfair competition means, have no major economic or criminal cases, and have never had contracts terminated or lost lawsuits as the defendant due to any breach of contract, illegal acts or violation of business ethics.The supplier shall provide sales performance records proving that the global sales volume of original 8-inch equipment of the same brand and model is no less than 10 units from January 1, 2023 to the present (subject to the contract signing date). The records shall clearly indicate the equipment sales date, corresponding client name (client names may be replaced by codes) and order quantity. During the bidding period, key pages of purchase orders, procurement contracts or user acceptance certificates and other supporting documents shall be submitted. The submitted documents shall be attached with a commitment stating that "All the above information is true and reliable. The bidder shall bear corresponding legal liabilities in case of any inconsistency with the facts", which shall be signed by the authorized representative and affixed with the official seal of the bidder. The tenderer reserves the right to inspect the original performance certificates when necessary. In addition to the above supporting documents, the bidder shall provide a letter of commitment on the authenticity of performance in the format specified in the tender documents.The bidder shall provide an enterprise basic information form, which may include detailed unit nature, registration information, business scope, industry-related qualification certificates (copies shall be provided) and other supporting documents that can prove the bidder"s qualification for this bidding activity according to actual conditions. The form shall be affixed with the official seal of the bidder to ensure the truthfulness and accuracy of all information.To prove that the bidder meets the above qualification requirements, the bidder shall submit supporting documents in accordance with the requirements in its bid documents.
