         Участникът следва да разполага с най-малко 1 (един) обект за производство и/или търговия с храни/групи храни, предмет на съответната обособена позиция, който е регистриран по реда на Закона за храните (ЗХ) (чл. 12 от ЗХ (отм.) или чл. 23 от ЗХ (обн. – ДВ, бр. 52 от 09.06.2020г.), съответно обектът да е вписан в регистъра по чл. 14 от ЗХ (отм.) или чл. 24, ал. 1 от ЗХ (обн. – ДВ, бр. 52 от 09.06.2020г.).

         - за чуждестранни лица - в аналогични регистри съгласно законодателството на държавата членка, в която са установени или на друга държава - страна по Споразумението за Европейското икономическо пространство.

         - в случай на обединение, което не е юридическо лице, изискването за регистрация се отнася за всеки участник в обединението, който ще извършва доставките, съобразно разпределението на участието на лицата при изпълнение на дейностите, предвидено в договора за създаване на обединение.
