Ziel des gegenständlichen Verfahrens war der Abschluss eines Pachtvertrags über Liegenschaften in Techelsberg am Wörthersee („Bad Saag“) zum Betrieb eines Strandbades mit ganzjähriger Gastronomie (zumindest über 10 Monate des Jahres) zwischen der Verpächterin einerseits und der/dem im Verfahren bestgereihten BieterIn andererseits.

Die Verpachtung erfolgt an eine Pächterin, welche auf den Liegenschaften ein Strandbad samt Gastronomie betreibt.

Value excluding VAT: 19 000 000.00 EUR

Der in Pkt. II.1.5., in Pkt. II.1.7. und in Pkt. V.2.4. angeführte Wert stellt den aus heutiger Sicht geschätzten (unverbindlichen) Gesamtumsatz der Pächterin über die gesamte Vertragslaufzeit dar. Der jährliche Pachtzins beträgt EUR 14.530,- welcher gemäß den Vorgaben im durchgeführten Verfahren bewertet wurde.

Die Vergabe unterlag dem Anwendungsbereich des Bundesvergabegesetzes Konzessionen 2018 idgF (im Folgenden „BVergGKonz 2018“) für besondere Dienstleistungen. Es fanden daher – sofern nicht anders angegeben – ausschließlich § 25 BVergGKonz 2018 sowie die in § 25 BVergGKonz 2018 genannten Bestimmungen des BVergGKonz 2018 Anwendung. Das Vergabeverfahren wurde als zweistufiges Verfahren mit Verhandlungen im Sinne der §§ 23 iVm 24 BVergGKonz 2018 durchgeführt.
