         Die Tirol Kliniken GmbH (TK) plant in den nächsten Jahren die Ersatzanschaffung von bis zu 2 therapeutischen Apheresegeräten für das Zentralinstitut für Bluttransfusion und Immunologische Abteilung mittels einer Rahmenvereinbarung. Bei darüberhinausgehendem Bedarf soll der Abruf von einem weiteren Gerät möglich sein. Bei einer Rahmenvereinbarung besteht generell keine Abnahmeverpflichtung seitens des Auftraggebers. Die TK legt ohne dieses Prinzip der Rahmenvereinbarung zu ändern und daher ohne Rechtsanspruch auf tatsächliche Bestellung offen, dass zum aktuellen Zeitpunkt die tatsächliche Beschaffung von 2 Geräten geplant ist und die Beschaffung eines weiteren Geräts eine grundsätzliche Möglichkeit im Fall von neuen Bedarfsmeldungen darstellt, weswegen ein Stück als „Option“ bezeichnet wird.

         Die Rahmenvereinbarung beinhaltet neben der Gerätelieferung auch die Lieferung der für den Betrieb benötigten Verbrauchsmaterialien (Sets). Pro Jahr werden ca. 460 therapeutische Apheresen mit verschiedenen Sets durchgeführt. Eine IT-Anbindung an die Software „MAK eprogesa“ sowie die Vollwartung der Geräte ist optional mit anzubieten. Die Laufzeit der Rahmenvereinbarung beträgt für den Abruf der Geräte 4 Jahre, für die Vollwartung und den Abruf der Verbrauchsmaterialien 7 Jahre (Geräte-Nutzungsdauer) ab Geräteinbetriebnahme.
