This is a notice of intent, not a request for a quotation. A solicitation document will not be issued and quotations will not be requested.
The National Institutes of Health (NIH), Office of Purchasing and Contracts intends to award a fixed price purchase order to Siemens Healthcare Diagnostics of Tarrytown, New York 10591-5005 on a sole source basis to provide Siemens Healthineers ADVIA® 120 Hematology System Preventative Maintenance Services for a base year with four potential option years to be exercised at the government’s discretion.

Siemens Healthcare Diagnostics is the original equipment manufacturer (OEM) and only reseller and distributor of its instruments, and reagents. Siemens is the only source that has trained, certified and authorized service technicians capable of performing the preventative maintenance on the government’s ADVIA® 120 Hematology System. Furthermore, the ADVIA® 120 Hematology System is proprietary in nature and only the OEM can perform services on the ADVIA® 120 Hematology System. Siemen uses OEM parts only which are compatible and designed to fit accurately with the hematology system. Using grey market parts would put the hematology system at risk of functioning improperly which in turn would put patient safety at risk. Siemens does not have any authorized third-party service provider and is the only source capable of meeting the government’s requirement in its entirety.
This acquisition is being conducted using policies unique to the Federal Acquisition Regulation (FAR) Part 13 – Simplified Acquisition Procedures, Subpart 13.106-1(b)(1), For purchases not exceeding the simplified acquisition threshold (SAT), contracting officers may solicit from one source if the contracting officer determines that the circumstance of the contract action deem only one source reasonably available. Contracts awarded using FAR Part 13-Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6-Competition Requirements.
