NOTICE OF INTENT TO SOLE SOURCE

The Food and Drug Administration, Office of Acquisitions and Grant Services, Facility Support Branch intends to award a firm fixed price purchase order to Peak Scientific Inc (Peak), Billerica, MA 01862 for a 12-month maintenance service agreement in support of two (2) Genuis NM32LA nitrogen generators for the Center for Food Safety and Applied Nutrition (CFSAN). The PEAK Genius gas generators are used to supply high purity nitrogen feed to the Liquid Chromatograph/Mass Spectrometer systems currently located in the CFSAN facilities. Performing annual preventative maintenance is essential in ensuring the proper operation of the spectrometers, which are used for analyses.

Peak is the sole provider for the original equipment parts, technical support, and all contractual maintenance for all Peak gas generators located within the United States (US). Peak does not train, nor authorize, any other organizations within the US to service or maintain Peak gas generators. In addition, Peak engineers are fully trained to repair, troubleshoot, and optimize the system using proprietary diagnostic tools and technology.

This procurement is being conducted in accordance with FAR subpart 13.106-1(b)(1)(i) which allows the Contracting Officer to solicit from one source. The North American Classification System Code is 811210, Electronic and Precision Equipment Repair and Maintenance and Product Service Code, J066 – Maintenance/Repair/Rebuild of Equipment – Instruments and Laboratory Equipment.

This notice is being distributed solely via the General Services Administration’s System for Awards Management website (www.SAM.gov). Interested parties are responsible for monitoring the site to ensure they have the most up-to-date information on this procurement. This notice is not a request for quotation; however, interested parties may identify their interests and/or capability in relation to this procurement to the Contract Specialist, Sheneil Green, at Sheneil.Green@fda.hhs.gov no later than 12:00 PM EST on August 29, 2023. Responses sent utilizing other means will not be considered. Information received will be used solely to determine whether to conduct a competitive procurement. A determination by the Government not to compete the proposed action based upon responses to this notice is at the discretion of the Government.

All responses must include the following business information:

1. Unique Entity Identification (UEI) Number
2. Company Name, address, primary point of contact and their email and phone number
3. Type of company (i.e. small business, 8a, woman-owned, HubZone, veteran owned, etc) as validated in SAM.gov. All interested parties must be registered in SAM.gov to receive consideration of government contracts.
