This is a notice of intent to solicit from a single source.

The Department of the Interiors Office of Surface Mining Reclamation and Enforcement (OSMRE) intends to a sole source a purchase order with Riegl USA for a terrestrial laser scanner and peripherals described in the attached Salient Characteristics.

Award will be made in accordance with Federal Acquisition Regulation (FAR) 13.106-1(b)(1) utilizing the provisions, clauses and procedures prescribed in FAR Part 12 entitled, Acquisition of Commercial Items and FAR Part 13 entitled, Simplified Acquisition Procedures, Subpart 13.5 entitled, Simplified Procedures for Certain Commercial Items.

The Riegl brand TLS system has unique capabilities both in regard to the hardware product features and to the integration with existing OSMRE¿s GNSS hardware and software expertise. The Riegl V-Line of 3D Laser Scanners are the only product capable of capturing data at 400,000 measurements per second with a range of 2,000 meters (6,561 feet. 1.24 miles) required by a multitude of ongoing and future open-pit coal mining reclamation-related projects. The Riegl TLS product can also collect color and infrared pixel data via integrated Infratech cameras expanding service capabilities related to mapping and 3D modeling at active and abandoned coal mine sites. The Riegl VZ-2000i was identified as the optimal TLS available for these SMCRA applications and compatible with OSMRE¿s existing software. Extensive market research determined that Riegl USA, Inc. is the only vendor that can provide this specific scanning system that will meet OSMRE¿s unique needs.

The purpose of this notice is to satisfy the requirements of FAR Subpart 5.2. This notice of intent is not a request for competitive quotes. However, interested responsible parties may respond to this notice by submitting a capability statement by the closing date of this announcement. All submissions will be considered, however there is no guarantee that submissions in response to this notice will in any way alter the Government¿s acquisition strategy. No solicitation will be issued.

Responses or inquiries shall only be accepted through electronic mail addressed to Susan Adams, Contracting Officer, sadams@osmre.gov and must be uploaded and received in their entirety no later than 12:00 PM ED, August 18, 2023. Responses to this notice shall not be considered as a response to any solicitation, a request to be added to a prospective offerors list, or to receive a copy of any solicitation. A determination by the Government not to compete the contract based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.

Note: In order to be eligible for award of a Government contract, vendors must be actively registered in the System for Award Management (SAM), have no active exclusions, and complete the FAR representations and certifications.
