The procurement falls outside the scope of application of the directive

Explanation:

ONS requires an extension to the contract to allow data to be delivered in the same format, same variables, and identical provision to allow continuation of statistical output. This 12-month extension is in anticipation of ONS running a competitive tender exercise for the new Statistical Business Register. This new single contract will combine requirements from this contract and from the Group Structure Data contract. ONS will update the market further in relation to the requirements in due course.

Therefore, ONS is utilising Regulation 32 (2) (b) (ii) - competition being absent for technical reasons.
