Exigences fondamentales:L"adjudicateur adjuge ce marché uniquement aux soumissionnaires qui respectent les conditions de participation fixées dans le dossier d"appel d"offres et dans la législation. Sont notamment concernés le respect des dispositions relatives à la protection des travailleurs, des conditions de travail, de l’égalité salariale entre femmes et hommes et du droit de l’environnement, et un comportement conforme aux règles de la concurrence et exempt de corruption.

Indication des voies de recours: Conformément à l"art. 56, al. 1, de la loi fédérale sur les marchés publics (LMP), la présente décision peut être attaquée, dans un délai de 20 jours à compter de sa notification, auprès du Tribunal administratif fédéral, case postale, 9023 Saint-Gall. Présenté en deux exemplaires, le mémoire de recours doit indiquer les conclusions, les motifs et les moyens de preuve et porter la signature de la partie recourante ou de son représentant ; y seront jointes une copie de la présente décision et les pièces invoquées comme moyens de preuve, lorsqu"elles sont disponibles. Conformément à l"art. 56, al. 2, LMP, les dispositions de la Loi fédérale sur la procédure administrative (PA) relatives à la suspension des délais ne s"appliquent pas.

Délai de clôture pour le dépôt des offres / Remarques: Le délai minimal de présentation des offres prévu à l"art. 46, al. 2, let. a, LMP (40 jours) a été réduit à 30 jours dans le présent appel d"offres. Conformément à l"art. 47 "Réduction du délai dans le domaine des traités internationaux", al. 2, LMP, le délai minimal de présentation des offres prévu à l"art. 46, al. 2, peut être réduit de cinq jours si a. l"appel d"offres est publié par voie électronique ; b. les documents d"appel d"offres sont publiés simultanément par voie électronique ; Ces deux conditions sont remplies par le présent appel d"offres. L"offre complète doit être envoyée en 3 exemplaires (2 exemplaires sur papier, 1 sur clé USB) à l"adresse indiquée au chapitre 10.1 du cahier des charges, au plus tard le 3 avril 2023 (date du cachet de la poste). Remarque concernant la remise des offres : a) Lors de la remise à la loge de Swissmedic (par le soumissionnaire ou par coursier) : La remise doit avoir lieu au plus tard à la date de remise susmentionnée, encore pendant les heures d"ouverture de la loge (c"est-à-dire du lundi au jeudi, 08h00 - 12h00 / 13h20 - 17h00 et le vendredi 08h00 - 12h00 / 13h20 - 16h00, adresse selon le chapitre 10.1 du cahier des charges, contre délivrance d"un récépissé de Swissmedic. b) En cas de remise par voie postale : le cachet postal ou le justificatif à code-barres d"un bureau de poste suisse ou d"un bureau de poste étranger reconnu par l"Etat est déterminant pour le respect du délai (les affranchissements d"entreprise ne sont pas considérés comme un cachet postal). En cas de remise par voie postale, le soumissionnaire doit s"assurer que l"offre est parvenue à Swissmedic au plus tard le 7 avril 2023. Le dernier délai de remise par la poste reste le 3 avril 2023. c) En cas de remise de l"offre à une représentation diplomatique ou consulaire suisse à l"étranger : l"offrant est tenu d"informer Swissmedic du lieu de remise (y compris l"adresse) par e-mail (markus.diethelm@swissmedic.ch) 10 jours avant l"expiration du délai de remise. En outre, il est tenu d"envoyer par e-mail l"accusé de réception de la représentation correspondante au plus tard à la date limite de remise de l"offre du mandant. L"adjudicateur doit dans tous les cas garantir la preuve que l"offre a été déposée en temps voulu. Les offres soumises trop tard ne peuvent plus être prises en considération. Elles seront renvoyées à l"offrant.
