Award of a contract without prior publication of a call for competition in the Official Journal of the European Union in the cases listed below
  • The services can be provided only by a particular economic operator for the following reason:
    • absence of competition for technical reasons
Explanation:

El objeto del acuerdo marco es no solo de realizar notificaciones sino que estas cuenten con presunción de veracidad y constancia en la entrega, presunción de la que goza la actuación del operador designado para la prestación del Servicio postal universal, es decir, la Sociedad Estatal Correos y Telégrafos S.A., hoy Sociedad Estatal Correos y Telégrafos S.A., S.M.E, tal y como se señala en el Art. 22.4 de la Ley 43/2010, de 30 de diciembre, que expresamente dispone que: “la actuación del operador designado para el Servicio Postal Universal goza de presunción de veracidad y fehaciencia en la distribución, entrega y recepción, o rehúse (rechazo), o imposibilidad de entrega, de notificaciones de órganos administratives y judiciales, tanto realizadas por medios físicos como telemáticos”.

Se constata que no existe en la actualidad en el mercado ninguna empresa alternativa
