Los derechos de exclusiva que Microsoft ostenta sobre la propiedad intelectual de sus productos y la posibilidad de acceder a su código fuente definen la razón principal por la que, en España, los Servicios integrales de Soporte de Microsoft, incluyendo todos sus componentes, sólo puede contratarse a Microsoft Ibérica, S.R.L. Por ello, Microsoft ostenta los derechos de exclusiva de Microsoft sobre su propiedad intelectual.

Los servicios de soporte objeto del contrato son ofrecidos únicamente por Microsoft Corporation o sus filiales, incluidos el personal técnico especializado y los proveedores de servicios externos que brindan soporte de acuerdo con las instrucciones de Microsoft.
