Award of a contract without prior publication of a call for competition in the Official Journal of the European Union in the cases listed below

The procurement falls outside the scope of application of the directive

Explanation:

Dada la catalogación de las Salas Operativas del CECOES 1-1-2 como Infraestructuras Críticas, así como la clasificación de Servicio Esencial asociada a la Directiva NIS II, es necesario garantizar el aislamiento absoluto del entorno tecnológico que garantiza la prestación de los servicios de atención a los ciudadanos en situación de urgencia y emergencia.

En consecuencia, estos equipos que actualmente soportan la seguridad los sistemas de la infraestructura crítica del CEOES 1-1-2, son necesarios para garantizar la plena operatividad de los mencionados sistemas de seguridad, no siendo posible la adaptación a otro tipo de licencias por razones de interés público, seguridad y eficiencia técnica. Además de lo anterior, se ha de tener en cuenta que la admisión de otro tipo de licencias requeriría la aplicación de un procedimiento con mayor concurrencia, dando publicidad a los sistemas de seguridad del CECOES 1-1-2, yendo en contra de la propia naturaleza del procedimiento negociado sin publicidad recogido en el artículo 168 a), 3º, LCSP, y, además, pondría en grave riesgo la seguridad de las Salas Operativas.
