Naročnik ugotavlja, da je nastopila potreba po spremembi okvirnega sporazuma in sicer na podlagi 2. točke prvega odstavka 95. člena ZJN-3.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:
Potreben so dodatne dobave blaga, ki jih izvede prvotni izvajalec, čeprav niso bile vključene v prvotno javno naročilo, ob čemer zamenjava izvajalca ni mogoča iz ekonomskih in
tehničnih razlogov ( npr. zahteva glede zamenljivosti ali interoperabilnosti z obstoječo opremo , storitvami ali inštalacijami, naročenimi v okviru prvotnega javnega naročila),
prav tako bi zamenjava izvajalca povzročila velike nevšečnosti ali znatno podvajanje stroškov. V času izvajanja OS je prišlo do nepredvidljivih okoliščin in bo naročnik v
obdobju izvajanja OS potreboval tudi druge vrste blaga, katere naročnik potrebuje za nemoteno poslovanje.
