  3. Section III
    1. Conditions for participation:
      1. Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers:
        List and brief description of conditions:

        a) Ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca in situatiile prevazute la art.164, 165, 167 din Legea nr. 98/2016 cu completările și modificările ulterioare;

        Pana la termenul limita de depunere a ofertelor fiecare operator economic participant la procedura de atribuire (ofertant, ofertant asociat, subcotractant, tert sustinator) va depune in format electronic, odata cu oferta, atât DUAE, completat cu informatiile aferente cerintelor/situației lor. DUAE va fi completat în SICAP în mod direct, după autentificare, de către fiecare participant care participă la procedură. Pentru cazurile în care ofertantul este o asociere de operatori economici sau pentru cazurile în care ofertantul are subcontractanți sau terți susținători, fiecare operator economic se va autentifica în sistem și va accesa procedura de atribuire de interes în vederea completării DUAE în calitatea în care a fost inclus în respectiva procedură (asociat, subcontractant, terț susținător).

        În conformitate cu prevederile art. 182 alin. (4) din Legea nr. 98/2016, cu modificările și completările ulterioare, odată cu angajamentul de susţinere, ofertantul/candidatul are obligaţia să prezinte documente transmise acestuia de către terţul/terţii susţinător/susţinători, din care să rezulte modul efectiv prin care terţul/terţii susţinător/susţinători va/vor asigura îndeplinirea propriului angajament de susţinere, documente care se vor constitui în anexe la respectivul angajament.

        Nedepunerea DUAE odata cu oferta (inclusiv pt asociati/terti sustinatori/subctractanti) atrage respingerea acesteia ca inacceptabila.Documentele justificative care probeaza îndeplinirea celor asumate prin completare DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante doar de catre ofertantii clasati pe primele trei locuri dupa aplicarea criteriului de atribuire asupra ofertei admisibile pana la incheierea raportului procedurii de atribuire, conform prevederilor art.196 alin (2) din Legea nr.98/2016.

        Documentele justificative sunt:

        -certificat eliberat de autoritatile legale competente, care sa ateste lipsa datoriilor restante, catre bugetul general consolidat, la momentul depunerii acestora, sau, în cazul operatorilor economici străini, documente echivalente emise în țara de rezidența

        -certificat eliberat de autoritatile legale competente, care sa ateste lipsa datoriilor restante, catre bugetul local, la momentul depunerii acestora, sau, în cazul operatorilor economici străini, documente echivalente emise în țara de rezidența-documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166 alin. (2), art. 167 alin. (2), art. 171 din Legea 98/2016 precum si orice alte documente edificatoare (dupa caz).

        -cazierul judiciar al operatorului economic si al membrilor organului de administratie, de conducere sau de supraveghere al respectivului operator economic, sau a celor care au putere de reprezentare, de decizie sau de control in cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC/actul constitutiv sau, în cazul operatorilor economici străini, documente echivalente emise în țara de rezidenta;

        -Alte documente edificatoare, dupa caz.

        Totodată, în ceea ce privește asociații persoane fizice care nu au și calitatea de administrator (deci nu figurează ca persoane împuternicite), în Actul constitutiv al societăţii se menționează puterile ce li s-au conferit şi dacă ei urmează să le exercite

        Persoanele juridice/fizice străine, ce doresc a participa la procedură, vor prezenta orice documente edificatoare, eliberate de autorități competente din țară în care aceștia sunt rezidenți, prin care să dovedească îndeplinirea obligațiilor restante cu privire la plata impozitelor și a asigurărilor sociale, la momentul prezentării acestora. În cazul în care în țara de origine sau țara în care este stabilit ofertantul/terțul susținător/subcontractantul nu se emit documente de natura celor prevăzute mai sus sau respectivele documente nu vizează toate situațiile prevăzute la art.164, art. 165 și art. 167 din Legea nr. 98/2016, autoritatea/entitatea contractantă are obligația de a accepta o declarație pe proprie răspundere sau, dacă în țara respectivă nu există prevederi legale referitoare la declarația pe propria răspundere, o declarație autentică dată în fața unui notar, a unei autorități administrative sau judiciare sau a unei asociații profesionale care are competențe în acest sens.Documentele se vor prezenta insotite de traducerea autorizata a acestora in limba romana.

        b) Neincadrarea in situatiile prevazute de art. 59 si 60 din Legea nr.98/2016 Ofertanţii (membrii asocierii, dacă este cazul), terții susținători și subcontractanții nu trebuie să se afle în situațiile prevăzute de dispozițiile art. 59 și 60 din Legea nr. 98/2016, cu modificările și completările ulterioare. In acest sens, se va depune Declarație pe propria răspundere privind inexistența conflictului de interese, cu menționarea persoanelor care dețin funcții de decizie în cadrul autorității contractante – se va completa Formularul nr. 2 din Secțiunea formulare.

        Modalitatea prin care poate fi demonstrată îndeplinirea cerinței:

        Ofertanţii (membrii asocierii, dacă este cazul), terții susținători și subcontractanții depun declarația privind neîncadrarea în situațiile potențial generatoare de conflict de interese, cu menționarea persoanelor care dețin funcții de decizie în cadrul autorității contractante. Declarația va fi prezentată odată cu DUAE.

        a)Operatorii economici (ofertant individual, membru al asocierii, subcontractant, tert sustinator, dupa caz) ce depun oferta trebuie sa dovedeasca o forma de înregistrare în conditiile legii din tara de rezidenta, sa reiasa ca operatorul economic este legal constituit, ca nu se afla în niciuna dintre situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul prezentei proceduri.

        Modalitatea prin care poate fi demonstrată îndeplinirea cerinței:

        Ca dovada preliminara pentru verificarea capacitatii de exercitare a activitatii profesionale, operatorii economici (ofertant individual, membru al asocierii, subcontractant, tert sustinator, dupa caz) trebuie sa prezinte DUAE completat cu informatiile aferente situatiei lor. Ofertantii clasati pe pe primele trei locuri dupa aplicarea criteriului de atribuire, anterior atribuirii contractului, va prezenta, la solicitarea expresa a Autoritatii contractante,documente justificative actualizate prin care sa probeze/sa confirme indeplinirea criteriului de calificare, in conformitate cu informatiile cuprinse in DUAE.

        Documentele justificative sunt:

        - certificatul constatator emis de ONRC sau, in cazul ofertantilor straini, documente echivalente emise in conformitate cu legislatia aplicabila in tara de rezidenta.

        Informatiile din certificatul constatator trebuie sa fie REALE/VALIDE LA DATA PREZENTARII ACESTUIA. Obiectul contractului trebuie să aibă corespondent în codul CAEN din certificatul constatator emis de O.N.R.C. sau de instituțiile abilitate (în cazul ofertanților străini). Cerința se aplică inclusiv pentru subcontractanți care completează informațiile aferente situației lor la nivelul unui DUAE distinct.

        b)Operatorii economici ce depun oferta trebuie să dețină Avizul de functionare si anexa eliberat de Ministerul Sanatatii pentru activitatea de comercializare, distributie din care sa rezulte producatorul ( pentru produsul oferit) pentru care unitatea avizata ( operatorul economic participant la proceduera de achizitie de publica) este distribuitor, valabil la data prezentarii-original/copie legalizata/copie lizibila cu mentiunea « conform cu originalul ». Actul normativ care impune obligativitatea acestei avizari : Legea nr.95/2006 privind reforma in domeniul sanatatii - Titlul XIX-privind dispozitivele medicale, republicata-Art.888, O.M.S 309/2015 – Norme metodologice de avizare a activitatii in domeniul dispozitivelor medicale –Art.3, sau in cazul persoanelor juridice (sau fizice, dupa caz), straine, vor prezenta documente echivalente pentru demonstrarea indeplinirii capacitatii de exercitare a activitatii profesionale: insotite de o traducere autorizata a acestora in limba romana. Avizul trebuie sa fie valabil la data prezentarii.

        Ca dovada preliminara pentru verificarea capacitatii de exercitare a activitatii profesionale, operatorii economici (ofertant individual, membru al asocierii, subcontractant, tert sustinator, dupa caz) trebuie sa prezinte DUAE completat cu informatiile aferente situatiei lor. Ofertantii clasati pe pe primele trei locuri dupa aplicarea criteriului de atribuire, anterior atribuirii contractului, va prezenta, la solicitarea expresa a Autoritatii contractante,documente justificative actualizate prin care sa probeze/sa confirme indeplinirea criteriului de calificare, in conformitate cu informatiile cuprinse in DUAE.

        Documentele justificative sunt:

        - Avizul Ministerului Sanatatii emis in baza prevederilor Legii 95/2006, art.926 privind reforma in domeniul sanatatii, cu modificarile si completarile ulterioare, pentru activitatile de comercializare, distributie si prestari servicii in domeniul dispozitivelor medicale.
