        Se va încheia ac-cadr cu un numar de max 5 operatori ec, pentru furnizarea de alimente necesare hranirii persoanelor private de libertate.

        Pentru determinarea ofertei cea mai avantajoasă din punct de vedere economic, criteriului de atribuire ce va fi aplicat este raportul catitate-pret.Acordul cadru se va încheia cu maxim 5 op. economici, se va stabili clasamentul în funcție de criteriul – raportul catitate-pret. Având în vedere faptul că în cazul organizării unei proceduri de atribuire pe loturi, autoritatea contractantă urmărește încheierea de contracte individuale de ach. publică pentru fiecare lot în parte, modul de stabilire a criteriului de atribuire sunt in conformitate cu prevederile art.187, alin. (3), lit. a) din Legea 98/2016.Pret: 40%- Ponderea de 40% se referă la ofertarea unor produse care să corespundă în totalitate specificațiilor tehnice/caietului de sarcini, în același timp constituind un criteriu important pentru departajarea ofertelor.Algoritm de calcul: Punctajul se acorda astfel: a) Pentru cel mai scazut dintre preturi se acorda punctajul maxim alocat; b) Pentru celelalte preturi ofertate punctajul P(n) se calculeaza proportional, astfel: P(n) = (Pret minim ofertat / Pret n) x punctaj maxim alocat. Lant aprovizionare 60%-Algoritm de punctare: - pentru livrările directe (de la producător la consumatorul final) se acordă punctajul maxim de 60 p; - pentru un singur intermediar implicat în lanțul de aprovizionare – se acordă 40 p; - pentru doi intermediari implicați în lanțul de aprovizionare – se acordă 20 p.Pentru demonstrarea factorului de evaluare „ Lant de aprovizionare” impreuna cu ofertele se va depune in cadrul propunerii tehnice dovada faptului ca operatorul economic este producatorul produsului respectiv sau forma de colaborare cu producatorul produsului (contract de furnizare, orice forma de intelegere scrisa semnata si stampilata intre producator si furnizorul care depune oferta purtand mentiunea „Conform cu originalul”).Ofertele care propun mai mult de doi intermediari implicați în lanțul de aprovizionare – SE ACORDA 0 P. Clasamentul se va intocmi in ordinea descrescatoare a punctajului total al ofertelor, calculat conform algoritmului descris mai sus. In cazul in care, dupa aplicarea criteriului de atribuire, doua sau mai multe oferte sunt clasate pe primele 3 locuri cu punctaje egale clasamentul se va intocmi in functie de factorul de evaluare Pret. Daca 2 sau mai multe oferte au punctaj egal si pret egal, clasamentul se va intocmi in functie de factorul de evaluare Lantul de aprovizionare. In situatia in care egalitatea se mentine, comisia de evaluare va solicita ofertantilor o noua propunere financiara in SEAP, caz in care clasamentul se va intocmi in functie de noile prop. financiare.daca dupa reofertare se mentine egalitatea, lotul se anuleaza

        Ac- cadru se semnează cu un număr de max 5 promitenți- furnizori, iar cs acestuia se vor încheia în următoarele condiții: a) de la data intrării în vigoare a prezentului acord- cadru, pentru o perioadă de 3 luni, prețurile produselor stipulate in contractele subsecvente nu pot fi modificate inauntrul perioadei de derulare a fiecaruia dintre aceste contracte, fiind stabilite la nivelul ofertei. b) atribuirea contractelor subsecvente ulterioare după primele 3 luni de la încheierea acordului cadru, până la finalizarea acestuia, se va face conform art.118 alin. 1, lit a) din Legea 98/2016. " a) fără reluarea competiţiei, în conformitate cu termenii şi condiţiile prevăzute în cuprinsul său, în cazul în care acordul-cadru stabileşte toţi termenii şi condiţiile care reglementează execuţia lucrărilor, prestarea serviciilor şi furnizarea produselor care constituie obiectul său, precum şi condiţiile obiective în funcţie de care se stabileşte care dintre operatorii economici parte la acordul-cadru va executa lucrările, va presta serviciile sau va furniza produsele "; Atribuirea se va face prin metoda ”cascadă” conform specificatiilor din caietul de sarcini.
