BNR va raspunde doar solicitarilor de clarificari transmise prin intermendiul SEAP pana la data limita stabilita.

                  Modalitatea de departajare a ofertelor clasate pe primul loc: În situația în care două sau mai multe oferte nu se pot departaja pe poziții distincte în clasament (au pret egal), autoritatea contractantă va recurge la solicitarea transmiterii de către operatorii economici de documente care conțin noi prețuri (re-ofertare de preț).

                  Cuantumul Garanției de Bună Execuție a Contractului reprezintă 7,5% din prețul Contractului fără TVA și se va constitui prin virament bancar, prin depunerea la casierie a unor sume în numerar dacă valoarea este mai mică de 5.000 lei, prin combinarea a două sau mai multe dintre modalităţile de constituire sau printr-un instrument de garantare emis în condiţiile legii, astfel:

                  a) scrisoare de garanţie emisă de o instituție de credit bancare sau de instituţii financiare nebancare din România sau din alt stat;

                  b) asigurare de garanţii emisă:

                  - fie de o societate de asigurări care deţine autorizaţie de funcţionare emisă în România sau într-un alt stat membru al Uniunii Europene şi/sau care este înscrisă în registrele publicate pe site-ul Autorităţii de Supraveghere Financiară, după caz;

                  - fie o societate de asigurări dintr-un stat terţ printr-o sucursală autorizată în România de către Autoritatea de Supraveghere Financiară;

                  Operatorii economici vor adresa solicitarile de clarificari in legatura cu documentatia de atribuire, in limba romana, prin intermediul S.E.A.P., in Sectiunea ”Solicitari de clarificare/Intrebari” din cadrul procedurii de atribuire derulate prin mijloace electronice iar raspunsurile la acestea vor fi publicate in limba romana, in SEAP la Sectiunea ”Lista clarificari, notificari si decizii” din cadrul anuntului de participare. In calculul termenului aferent solicitărilor de clarificari adresate de operatorii economici cu privire la documentatia de atribuire, data transmiterii solicitării de clarificări în S.E.A.P. (SICAP) si data limita stabilita pentru depunerea ofertelor nu se iau in calcul. In calculul termenului de raspuns la solicitarile de clarificari, data publicarii raspunsului la solicitarile de clarificari si data limita precizata pentru depunerea ofertelor nu se iau in calcul.

                  Pentru transmiterea solicitarilor de clarificari operatorii economici trebuie sa se inregistreze in S.E.A.P. (SICAP) (www.e-licitatie.ro) ca operator economic si sa se inscrie la procedura de atribuire, ca participant. Detalii privind inregistrarea in SEAP (SICAP) si participarea la procedurile de atribuire online se pot obtine de la operatorul SEAP (SICAP) ( www.e-licitatie.ro ).

                  Comisia de evaluare va transmite solicitarile de clarificare in legatura cu oferta, in limba romana, prin utilizarea facilitatilor tehnice disponibile in SEAP - Sectiunea “Solicitari de clarificare/Intrebari”. Operatorii economici vor transmite raspunsurile la clarificari si eventualele documente solicitate pe parcursul evaluarii ofertelor, prin intermediul SEAP - Sectiunea “Solicitari de clarificare/Intrebari”, integral in sectiunea corespunzatoare respectivei solicitari, in format electronic, sub forma unuia sau a mai multor documente/fisiere distincte semnate cu semnatura electronica conform prevederilor Legii nr. 455/2001 privind semnatura electronica.

                  Toate documentele/inscrisurile referitoare la procedura de atribuire, transmise de catre ofertanti (oferta, documente de calificare, solicitari de clarificari, raspunsuri la solicitarile de clarificari) vor fi redactate in limba romana sau vor fi prezentate insotite de traducerea autorizata in limba romana.

                  Pentru participare la procedura de atribuire, toți ofertanții/ofertanții asociați, subcontractanții și terții susținători trebuie să fie înregistrați în SEAP și să dețină un certificat digital valid necesar accesului în SEAP, precum și în termen de valabilitate.

                  Toate cerintele sunt obligatorii.

                  Cerintele tehnice definite la nivelul anuntului de participare, caietului de sarcini sau altor documente complementare, prin trimiterea standardelor, la un anumit producator, la marci, brevete, tipuri, la o origine sau la o productie/metoda specifica de fabricatie/prestare/executie, vor fi intelese ca fiind insotite de mentiunea ”sau echivalent”.
