    1. Conditions for participation:
      1. Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers:
        List and brief description of conditions:

        Completare DUAE care confirma ca ofertantul, tertii sustinatori si subcontractantii nu se afla în niciuna din situatiile de excludere mentionate la art. 59-60, 164, 165 si 167 din Legea 98/2016.

        Declaratia privind neincadrarea in prev. art.59- 60 se va prezenta odata cu DUAE.

        Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE si care urmeaza a fi prezentate la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul 1 in clasamentul intermediar intocmit dupa aplicarea criteriului de atribuire sunt:

        - certificate constatatoare privind lipsa datoriilor restante cu privire la plata impozitelor sau a contributiilor la bugetul general consolidate (buget local, buget de stat) la momentul prezentarii (operatorul economic prezintă pentru sediul principal documente din care să reiasă neîncadrarea în prevederile art. 165 alin. (1), iar pentru sediile secundare/punctele de lucru, o declaraţie pe propria răspundere privind îndeplinirea obligaţiilor de plată a impozitelor, taxelor sau contribuţiilor la bugetul general consolidat datorate);

        - cazierul judiciar al operatorului economic si al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic, sau al celor ce au putere de reprezentare, de decizie sau de control in cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC/actul constitutiv;

        - dupa caz, documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute art. 166 al.2, art.167 al. 2, art. 171 din legea 98/2016 privind achizitiile publice.

        Persoanele ce detin functii de decizie in cadrul autoritatii contractante sunt: directorul general Ion Pantelimon, director financiar contabilitate ec. Zoita Bumb, director tehnic-productie ing. Ioan Morocazan, sef serviciu achizitii ing. Bianca Pirlea, sef birou juridic consilier juridic Emese Vasilie-Pap.

        Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de inregistrare in conditiile legii din tara de rezidenta, sa reiasa ca operatorul economic este legal constituit, ca nu se afla in nici una dintre situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului. Modalitate de indeplinire: completare DUAE, urmand ca documentul justificativ, respectiv certificat ONRC sau pt ofertantii straini document echivalent emis in tara de rezidenta (in limba in care a fost emis, insotit de traducerea in limba romana efectuata in mod obligatoriu de catre traducatori autorizati), urmeaza sa fie prezentat la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul 1 in clasamentul intermediar intocmit dupa aplicarea criteriului de atribuire.

        Obiectul contractului trebuie sa aiba corespondent in codul CAEN din certificat constatator emis de oficiul registrului comertului.

        Loturile: 1,2,3Pentru contractele de achizitie de servicii: executarea de servicii de tipul specificatOfertantul trebuie sa demonstreze ca a prestat in ultimii 3 ani servicii similare cu cele descrise in caietul de sarcini, respectiv: pentru lotul 1- inchiriere de autobasculante cu sofer pentru transport de materiale (agregate, ciment, etc), in valoare de minim cumulat de 7.500.000 lei, valoare prevazuta la nivelul a minim 1 contract sau a maxim 3 contracte pentru lotul 2- inchiriere de autobasculante 6x4 cu sofer in valoare de minim cumulat de 5.000.000 lei, valoare prevazuta la nivelul a minim 1 contract sau a maxim 3 contracte pentru lotul 3-inchiriere buldoexcavatoare in valoare de minim cumulat de 3.000.000 lei,valoare prevazuta la nivelul a minim 1 contract sau a maxim 3 contracte Prin experienta similara se intelege: servicii de inchiriere de autobasculante -pentru lot 1 si 2 servicii inchiriere/lucrari de constructii de drumuri, refaceri carosabil și trotuar prin inchiriere de diverse utilaje de terasamente de tipul celor solicitate in caietul de sarcini, pentru lot 3.

        Toate acestea se vor declara in DUAE prin completare DUAE de catre operatorii economici participanti la procedura de atribuire. Prezentarea de documente justificative se va face doar la solicitarea autoritatii contractante, ofertantului aflat pe primul loc in clasamentul intermediar intocmit după aplicarea criteriului de atribuire, acestea fiind: procese verbale de receptie/ documente constatatoare/ recomandari, alte documente edificatoare; documentele justificative vor fi emise sau contrasemnate de beneficiar (autoritate contractanta sau client privat) vor indica cel putin urmatoarele: tipul serviciilor prestate pentru verificarea indeplinirii cerintei, beneficiarii, valoarea contractului, modul de indeplinire al contractului
