        Furnizare ECHIPAMENTE MEDICALE, conform cerintelor din Caietul de sarcini si Anexei la Caietul de sarcini.

        A. In conformitate cu prevederile art. 160, alin. (1) si art. 161, alin. (2) din Legea nr. 98/2016, termenul limita pana la care orice operator economic interesat are dreptul de a solicita clarificari sau informatii suplimentare in legatura cu documentatia de atribuire este de maxim 18 zile inainte de data limita de depunere a ofertelor.

        B. In conformitate cu prevederile art. 160, alin. (2) si art. 161, alin. (2) din Legea nr. 98/2016 autoritatea contractanta va raspunde in mod clar si complet tuturor solicitarilor de clarficare/informatiilor suplimentare in a 11-a zi dinainte de termenul limita stabilit pentru depunerea ofertelor.

        Orice solicitare de clarificare transmisa dupa data mentionata la punctul A., va pune AC in imposibilitatea de a oferi un raspuns in termenul mentionat la punctul B. si drept urmare orice solicitare de clarificare in afara termenelor mentionate se va considera TARDIVA.

                        Documentaţia va fi descărcată de pe site-ul www.sicap-prod.e-licitatie.ro. Toate solicitarile de clarificari formulate din partea operatorilor economici si toate răspunsurile la solicitările de clarificări cerute de operatorii economici sau formulate de autoritatea contractantă/decizii CNSC/contestaţii/note de informare/măsuri de remediere vor fi postate pe site-ul www.sicap-prod.e-licitatie.ro rubrica Documentaţii/clarificări/decizii, precum şi prin publicare de erate.

                        Daca pe primul loc in clasament, doua sau mai multe oferte au o valoare totala egala a propunerii financiare si sunt clasate pe acelasi loc, in vederea departajarii, autoritatea contractantă va solicita clarificari prin intermediul noului SEAP (SICAP), in vederea incarcarii electronice de catre operatorii economici de documente care contin noi preturi. Oferta cu cel mai scazut pret va fi declarata castigatoare.

                        În cazul în care două sau mai multe oferte sunt clasate pe primul loc, cu punctaje egale, departajarea se va face având în vedere punctajul obţinut la factorii de evaluare, în ordinea descrescătoare a ponderilor acestora. În situaţia în care egalitatea se menţine, entitatea contractantă are dreptul să solicite noi propuneri financiare şi oferta câştigătoare va fi desemnată cea cu propunerea financiară cea mai mică.

                        Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe primul loc in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.

                        Propunerea tehnica si propunerea financiara, precum si documentele de calificare solicitate in sustinerea DUAE se vor depune in SICAP in format pdf sau word, separate, semnate cu semnatura electronica extinsa, bazată pe un certificat calificat, eliberat de un furnizor de servicii de certificare acreditat.

                        Operatorii economici au obligatia de a mentiona care dintre informatiile din cadrul ofertei sale sunt confidentiale, clasificate sau protejate de un drept de proprietate intelectuala, potrivit legii.

                        Orice stersatura, adaugare, interliniere sau scris peste cel dinainte sunt valide doar daca sunt vizate de catre persoana/persoanele autorizata/autorizate sa semneze oferta.

                        Cerintele tehnice definite la nivelul anuntului de participare, caietului de sarcini sau altor documente complementare, prin trimiterea standardelor, la un anumit producator, la marci, brevete, tipuri, la o origine sau la o productie/metoda specifica de fabricatie/prestare/executie, vor fi intelese ca fiind insotite de mentiunea ”sau echivalent”.

                        Atentie! Toate documentele/ofertele depuse pe SEAP trebuie sa fie semnate cu semnatura electronica extinsa.

                        Nedepunerea DUAE odata cu oferta (inclusiv pentru asociat/tert sustinator) atrage respingerea acesteia ca inacceptabila.

                        În cazul în care ofertantul/candidatul demonstrează îndeplinirea criteriilor referitoare la situaţia economică şi financiară ori privind capacitatea tehnică şi profesională bazându-se pe capacităţile altor entităţi, invocând, după caz, susţinerea unui terţ, DUAE, împreună cu angajamentul de susţinere, trebuie să fie completat separat şi de către terţul/terţii susţinător (i) pe a căror capacitate se bazează ofertantul/ candidatul.

                        CLAUZA SUSPENSIVĂ: Procedura de atribuire este inițiată sub incidența prezentei clauze suspensive, în sensul că încheierea Contractului de achiziție publica ce va rezulta din această procedură, este condiționată de incadrarea termenului de livrare ofertat, astfel incat sa nu se depaseasca data de 15.06.2023 impusa prin Documentatia de atribuire. În cazul în care, indiferent de motive, procedura de atribuire nu se va finaliza in timp util astfel incat sa se respecte de catre ofertantul castigator termenul maxim de livrare de 15.06.2023, Spitalul Orasenesc Faget îsi rezervă dreptul de a aplica prevederile art. 212 alin (1) lit. c) din Legea nr. 98/2016 privind achizițiile publice, cu modificările și completările ulterioare, fiind imposibilă încheierea Contractului de achiziție publica intrucat neimplementarea proiectului pana la data de 30.06.2023, fără posibilitatea de prelungire după această dată, conduce la pierderea finantarii din cadrul POIM 2014-2020. Ofertanții din cadrul acestei proceduri înțeleg ca Autoritatea Contractantă și/sau Ministerul Investițiilor și Proiectelor Europene, nu pot fi considerați răspunzători pentru vreun prejudiciu în cazul anularii procedurii de atribuire, indiferent de natura acestuia și indiferent dacă Autoritatea Contractantă și/sau Ministerul Investițiilor și Proiectelor Europene, au fost notificați asupra existenței unui asemenea prejudiciu.

                        Ofertanții din cadrul acestei proceduri acceptă utilizarea clauzei suspensive, asumându-si întreaga raspundere în raport cu eventualele prejudicii pe care le-ar putea suferi în situația descrisă. Autoritatea Contractantă estimează că procedura de atribuire se va finaliza la inceputul lunii mai 2023, iar contractul de furnizare cu ofertantul declarat caștigător va fi încheiat în termen de 12 zile de la data transmiterii comunicarilor de rezultat procedura, dată de la care încetează efectele prezentei clauze suspensive.
