    1. Conditions for participation:

        List and brief description of conditions:

        Cerinta 1

        Declaratie pe proprie raspundere din care sa reiasa ca operatorul economic nu se afla , avand in vedere actiunile sau inactiunile savarsite inainte de initierea procedurii , in una dintre situatiile prevazute la art. 164, art. 165 si art. 167 din Legea privind achizitiile publice nr. 98/23.05.2016.

        Modalitate de demonstrare a indeplinirii cerintei : se va completa DUAE de catre operatorii paticipanti la procedura( ofertanti, terti sustinatori, subcontractanti).

        Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate , la solicitarea autoritatii contractante , doar de catre ofertantii clasati pe locul I in clasament in urma finalizarii evaluarii ofertelor.

        Documentele justificative mentionate mai sunt:1 certificate constatatoare privind lipsa datoriilor restante cu privire la plata impozitelor si taxelor sau a contributiilor la bugetul general consolidat(buget local, buget de stat etc.)la momentul prezentarii; In cazul in care operatorul economic are inregistrate , conform Cerificatului constatator emis de ONRC, puncte de lucru in alte circumscriptii teritoriale fiscale , in afara celei in care are declarat sediul social ( ex. comune, municipii, judete), atunci se va prezenta o declaratie de proprie raspundere in acest sens.

        2.cazierul judiciar al operatorului si al membrilor organului de administrare , de conduceresau de supraveghere al respectivului operator economic, sau a celor ce au putere de reprezentare, de decizie sau de control in cadrul acestuia, asa cum rezulta din cerificatul constatator emis de ONRC/ actul constitutiv;

        3.dupa caz, documente prin care se demonstreaza faptul ca operatorul poate beneficia de derogarile prevazute la art. 166 alin.2, art.167 alin. 2, art. 171 din Legea 98/2016 privind achizitiile publice;

        4-alte documente edificatoare, dupa caz.

        Cerinta 2

        Declaratie privind neincadrarea in situatiile prevazute la art.60 alin.1 din Legea 98/2016.

        Cerinta nr. 1

        Capacitatea de exercitare a activitatii profesionale

        Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de inregistrare in conditiile legii din tara de rezidenta, sa reiasa ca operatorul economic este legal constituit , ca nu se afla in niciuna dintre situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiecul contractului.

        Modalitate de indeplinire : Completare DUAE, urmand ca documentul justificativ, respective certificat ONRC, sau pentru ofertantii straini document echivalent emise in tara de rezidenta, sa fie prezentat doar la solicitarea autoritatii contractante la finalizarea evaluarii ofertelor.

        Cerinta nr.2

        Operatorii economici ce depun oferta trebuie sa detina atestare ori apartenenta din punct de vedere profesional respectiv sa detina aviz de la Miniterul Sanatatii valabil la momentul prezentarii, privind autorizatia de functionare a depozitului in conformitate cu Legea 95/2006, art. 800 privind reforma in domeniul sanatatii, Titlul XVIII Medicamentul , cu modificarile si completarile ulterioare si Ordinul ministerului sanatatii publice nr. 1964/2008 pentru aprobarea Normelor privind infiintarea, organizarea si functionarea unitatilor de distributie angro de medicamente de uz uman.

        Modalitate de indeplinire:se va completa DUAE, urmand ca documentul justificativ ( avizul de functionare) sau pentru ofertanti straini , document echivalent emis in tara de rezidenta, sa fie prezentat doar la solicitarea autoritatii contractante la finalizarea evaluarii ofertelor.
