        Servicii de exploatari forestiere care constau în: - doborât, sectionat, adunat, scos apropiat în platforma primara; - curatirea parchetelor (daca este cazul), conform OM 1540/2011 cu modificarile si completarile ulterioare; - sortarea masei lemnoase în platforma primara pe tasoane - fasonarea in steri a lemnului de foc .Numar zile pana la care se pot solicita clarificari inainte de data limita de depunere a ofertelor-10 zile. Raspunsul tuturor solicitărilor de clarificări/informațiilor suplimentare se va face în a-5-a zi dinainte de termenul limită stabilit pentru depunerea ofertelor.

            1Perioada de valab. a ofertelor 90 zile de la termenul limita de depunere a ofertelor. Note: a) Autoritatea contractanta are dreptul de a solicita ofertantilor, în circumstante exceptionale, înainte de expirarea perioadei de valabilitate a ofertei, prelungirea acestei perioade. In cazul extinderii perioadei de valabilitate a ofertei perioada de valabilitate a garantiei pentru participare va fi prelungita în mod corespunzator. b) Ofertantul are obligatia de a comunica autoritatii contractante daca este sau nu de acord cu prelungirea perioadei de valabilitate a ofertei. c) Daca ofertantul refuză să-si prelungească perioada de valabilitate a ofertei si a garantiei de participare oferta este respinsă ca inacceptabilă in conformitate cu art. 137, alin (2), lit. i) din H.G. nr. 395/2016 cu moficarile si completarile ulterioare. d) Limba de redactare a ofertei - Romana. Toate certificatele si documentele emise in alta limba decat romana vor fi insotite de traducerea autorizata a acestora in limba romana. In cazul in care operatorii economici participanti la procedura de atribuire uzeaza de drepturile prevazute la art 193 din Legea 98/2016 prin completarea DUAE, documentele justificative care probeaza îndeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul I. e) Solicitarile de clarificari ale potentialilor ofertanti se vor adresa in mod exclusiv in SEAP la Sectiunea ”Intrebari” din cadrul procedurii de atribuire derulate prin mijloace electronice iar raspunsurile la acestea vor fi publicate in SEAP, la Sectiunea ”Documentatie si Clarificari” din cadrul anuntului de participare,AC urmand sa nu dea curs solicitarilor adresate prin alta modalitate de comunicare decat cea stabilita in conformitate cu prevederile art. 64 alin. (1) din Lg nr. 98/2016 pentru comunicarile ulterioare depunerii ofertelor. f) Comisia de evaluare va transmite solicitarile de clarificare privind ofertele depuse, in SEAP la Sectiunea “Intrebari”. Operatorii economici vor transmite raspunsurile la clarificari si eventualele documente solicitate pe parcursul evaluarii ofertelor prin intermediul SEAP (Sectiunea “Intrebari”), integral in sectiunea corespunzatoare respectivei solicitari, sub forma unuia sau a mai multor documente/fisiere distincte semnate cu semnatura electronica extinsa. g) Ofertantul va prezenta o declaratie prin care accepta clauzele contractuale cuprinse în modelul de contract din documentatia de atribuire. Daca un operator economic considera ca anumite clauze contractuale îi sunt în defavarabile, poate solicita autoritatii contractante clarificari, inclusiv modificarea lor, astfel încat daca aceste clauze vor fi amendate/modificate ele sa fie aduse la cunostinta tuturor operatorilor economici interesati, înainte de data limita de depunere a ofertelor. Amendamentele la clauzele contractuale pot fi prezentate si odata cu depunerea ofertei tehnnice. Dacă oferta conţine propuneri de modificare a clauzelor contractuale pe care le-a stabilit autoritatea contractantă în cadrul documentaţiei de atribuire, care sunt în mod evident dezavantajoase pentru aceasta din urmă, iar ofertantul, deşi a fost informat cu privire la respectiva situaţie, nu acceptă renunţarea la clauzele respective, se vor aplica prevederile art. 137alin. (3) lit. (b) din H.G. nr. 395/2016 cu modificarile si completarile ulterioare.. i) În cazul unor situatii neprevazute autoritatea contractanta poate modifica contractul în baza art 221 din Lg 98/2016. Cerintele tehnice definite la nivelul anuntului de participare, caietului de sarcini sau altor documente complementare, prin trimiterea standardelor, la un anumit producator, la marci, brevete, tipuri, la o origine sau la o productie/metoda specifica de fabricatie/prestare/executie, vor fi intelese ca fiind insotite de mentiunea ”sau echivalent.

            Garanția de bună execuție a contractului. Executarea contractului începe după constituirea garanției de bună execuție, în termen de maxim 5 zile lucrătoare de la semnarea contractului de servicii de către ambele părți, pentru toată perioada de valabilitate a contractului. Termenul de constituire a garanţiei de bună execuţie poate fi prelungit la solicitarea justificată a contractantului, fără a depăşi 15 zile de la data semnării contractului de achiziţie publică.

            Autoritatea contractanta doreste sa beneficieze de prevederile art.74 alin.(2) din Legea 98/2016 iar in acest sens a publicat in SEAP anuntul de intentie cu numarul PI1002701/08.09.2022.

            Atribuire loturi: Ofertantul clasat pe primul loc după aplicarea criteriului de atribuire, va fi declarat câştigător pentru loturile/partizile a căror volume cumulate, în sens descrescător al volumului partizilor la care ofertantul se află pe primul loc (începând cu partida cu volumul cel mai mare, continuând până la partida cu cel mai mic volum), se încadrează în capacitatea de exploatare rămasă disponibilă. În cazul în care două loturi/partizi au volume egale şi nu se încadrează în capcitatea de exploatare rămasă disponibilă, ofertantului i se va atribui lotul/partida la care diferenţa dintre valoarea estimată şi valoarea ofertată este cea mai mare.
