        D.U.A.E.(Documentul Unic de Achizitie European). - Potrivit prevederilor art. 193 din Legea 98/2016, autoritatea contractanta va accepta in cadrul ofertelor DUAE, in locul documentelor solicitate in vederea demonstrarii cerintelor de calificare, ca dovada preliminara. DUAE poate fi descarcat in vederea completarii si depunerii de la adresa https://ec.europa.eu/tools/espd (instructiuni privind completarea DUAE sunt disponibile la adresa www.e-licitatie.ro).

        In cazul in care operatorul economic demonstreaza indeplinirea criteriilor referitoare la situatia economica si financiara ori privind capacitatea tehnica si profesionala invocand sustinerea unui tert, DUAE include informatiile mentionate la alin.(1) cu privire la tertul sustinator.

        In cazul in care operatorul economic intentioneaza sa subocntracteze o parte/parti din contract, DUAE include si informatiile solicitate cu privire la subcontractanti.

        DUAE se va depune, dupa caz, de catre tertul sustinator si de subcontractant.

        Ofertantii/tertii sustinatori si subcontractantii nu trebuie sa se regaseasca in situatiile prevazute la art. 164,165, 167 din Legea 98/2016. Modalitatea prin care poate fi demonstrata indeplinirea cerintei: se va completa DUAE conform art. 193, alin 1 din Legea 98/2016 cu informatiile aferente situatiei lor.

        Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate , la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul I.

        Autoritatea contractanta poate solicita ofertantilor sa depuna toate sau o parte dintre documentele justificative ca dovada a informatiilor cuprinse in DUAE, in orice moment pe durata desfasurarii unei proceduri de atribuire, daca acest lucru este necesar pentru a asigura desfasurarea corespunzatoare a procedurii.

        Documentele justificative pot fi:

        a) certificate constatatoare privind lipsa datoriilor restante cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat (buget de stat, buget local, etc) la momentul prezentarii;

        b) cazierul judiciar al operatorului economic si al membrilor organului de administrare de conducere sau de supravegere a respectivului operator economic sau a celor care au putere de reprezentare de decizie sau de control in cazul acesteia asa cum rezulta din certificatul constatator emis de ONRC sau actul constitutiv.

        c) documente prin care se demonstreaza ca operatorul economic poate beneficia de derogarile prevazute la art.166 al. 2; art.167, al.2; art. 171, din Legea 98/2016 (daca este cazul);

        d) alte documente edificatoare, dupa caz.

        Documentele scanate vor fi depuse in SEAP, semnate electronic cu semnatura electronica extinsa.

        Informatiile cuprinse in documentele justificative trebuie sa fie reale/valide la data prezentarii acestora.

        Pentru persoane juridice/fizice străine se vor prezenta documente echivalente emise în țara de rezidență; documentele care dovedesc o forma de înregistrare / atestare vor fi prezentate în traducere autorizata în limba română.

        Ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca in situatiile prevazute de art. 58-60 din Legea 98/2016. In aplicarea prevederilor de la art. 60(1), litera d din Legea 98/2016, precizam persoanele ce detin functie de decizie in autoritatea contractanta cu privire la organizarea si finalizarea procedurii de atribuire:

        Atentionari speciale:

        1.Se vor depune, odata cu DUAE, urmatoarele documente: angajamentul ferm al tertului sustinator din care rezulta modul efectiv in care se va materializa sustinerea acestuia, a acordului de subcontractare si /sau a acordului de asociere, daca este cazul.

        2.Nedepunerea acestora odata cu DUAE constituie temei pentru solicitarea de clarificari pentru eventualele inadvertente de forma a informatiilor cuprinse in sectiunile DUAE, atat ale ofertantului/candidatului, cat si a subcontractantului/tertului sustinator, acest lucru fiind necesar pentru a asigura desfasurarea corespunzatoare a procedurii de atribuire.

        Cerința nr. 1.

        Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de inregistrare in conditiile legii din tara de rezidenta, sa reiasa ca operatorul economic este legal constituit, ca nu se afla in nici una dintre situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului.

        Modalitate de indeplinire: completare DUAE in conformitate cu notificarea nr. 240/2016 - ANAP, urmand ca documentul justificativ respectiv certificatul ONRC sau pentru ofertantii straini, documente echivalente emise in tara de rezidenta sa fie prezentate la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul I.

        DUAE se va depune, dupa caz, si de catre tertul sustinator.

        Cerința nr. 2.

        Ofertantul/candidatul trebuie să aibă dreptul de a presta serviciile prevăzute la Art. 62 alin. 2) din Codul Silvic, care precizează că „ Exploatarea masei lemnoase se face doar de operatori economici atestați de către comisia de atestare, care funcționează în cadrul asociației patronale și profesionale din domeniul forestier recunoscută la nivel național ”.

        Modalitate de indeplinire: Completare DUAE de către operatorii economici participanți la procedura de atribuire cu informațiile aferente situației lor, in conformitate cu notificarea nr. 240/2016 - ANAP, urmand ca la finalizarea evaluării ofertelor autoritatea contractantă să solicite ofertantului clasat locul I următoarele documente justificative:

        Certificat de atestare/reatestare eliberat de Comisia de Atestare a Operatorilor Economici în Activitatea de Exploatare Forestieră.

        Pentru persoane juridice/fizice străine se vor prezenta documente echivalente emise în țara de rezidență în traducere autorizata în limba română. Din acesta trebuie să rezulte că ofertantul/candidatul are capacitate de exploatare rămasă disponibilă conform Certificatului de atestare în exploatare pentru volumul pentru care licitează.

        Justificare: Cerința a fost impusă în virtutea art. 62 pct. 2) din Legea nr. 46/2008 republicată – Codul Silvic.
