    1. Conditions for participation:
      1. Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers:
        List and brief description of conditions:

        Declaratie privind neincadrarea in prevederile art. 164, art. 165 si art. 167 din Legea nr. 98/2016 privind achizitiile publice.

        Modalitate de indeplinire: se va prezenta DUAE (elaborat conform formularului standard aprobat de Comisia Europeana la adresa URL:https://ec.europa.eu/growth/tools-databases/espd/filter).Necompletarea DUAE-lui in conformitate cu criterile stabilite de autoritatea contractanta, duce la respingerea ofertei ca inacceptabila si neconforma.

        Precizari: Formularul DUAE este pus la dispozitia ofertantilor la sectiunea Documentatie si clarificari.

        a. In cazul depunerii unei oferte in asociere, fiecare asociat are obligatia de a demonstra indeplinirea cerintei. Aceasta declaratie se solicita si eventualilor subcontractanti. In cazul depunerii unei oferte individuale/comune sustinuta tehnico-profesional de catre tert/terti sustinatori,fiecare sustinator are obligatia de a demonstra indeplinirea cerintei.

        - documentele de confirmare ale asociatilor/subcontractantilor/tertilor sustinatori vor fi prezentate, in urma solicitarii autoritatii contractante,de ofertantul clasat pe locul I in clasamentul intermediar.

        b. Incadrarea in una sau mai multe dintre situatiile prevazute la art. 164, art. 165 si art. 167 din Legea nr. 98/2016 privind achizitiile publice, atrage excluderea ofertantului din procedura pentru atribuirea contractului;

        c. Ofertantul clasat pe primul loc in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor va prezenta, la solicitarea autoritatii contractante, documentele justificative care probeaza indeplinirea cerintelor asumate, dupa cum urmeaza:

        - certificate constatatoare privind lipsa datoriilor restante la momentul prezentarii acestora, cu privire la plata impozitelor, taxelor si a contributiilor de asigurari sociale la bugetul de stat si la bugetul local ce vor fi depuse in urma solicitarii autoritatii contractante adresate ofertantului clasat pe locul I in clasamentul intermediar, iar pentru sediile secundare/punctele de lucru, cerinta se va putea demonstra printr-o declaraţie pe propria răspundere privind îndeplinirea obligaţiilor de plată a impozitelor, taxelor sau contribuţiilor la bugetul general consolidat datorate

        - cazierul judiciar al operatorului economic si al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator ecomonic, sau a celor ce au putere de reprezentare, de decizie sau de control in cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC/actul constitutiv.

        - in cazul in care in tara de origine sau in tara in care este stabilit operatorul economic, nu se emit documente de tipul celor solicitate sau acestea nu vizeaza toate situatiile cuprinse la art. 164, art. 165 si art. 167, se accepta orice document considerat edificator emis de autoritati competente din tara respectiva;

        - in cazul ofertantilor persoane juridice/fizice straine documentele vor fi transmise in limba in care au fost emise insotite de o traducere autorizata a acestora in limba romana.

        În sensul prevederilor articolului 63, aliniat (1) din Legea 98/2016 privind achizitiile publice,persoane cu functie de decizie din cadrul Directiei Silvice Caras-Severin: Tabugan Ion, Polita Daniel, Balgar Ondina, Zaberca Nicoleta, Cimpan Dan, Budaci Cristian

        Cerinta nr.1

        Operatorii economici trebuie sa fie legal inregistrati si sa aiba dreptul de a derula contractul. Cerinta trebuie indeplinita de catre toti participantii la procedura (lider, asociat, subcontractant) pentru partea /partile de contract pe care acestia urmeaza sa o indeplineasca efectiv.

        Se vor depune documentele:

        Initial se va completa formularul DUAE din documentatia de atribuire. Numai la solicitarea autoritatii contractante se va depune Certificatul constatator eliberat de Oficiul Registrului Comertului. Datele prevazute în certificat trebuie sa fie reale/actuale la momentul prezentarii acestuia. Obiectul contractului trebuie sa aiba corespondent în codul CAEN din certificatul constatator emis

        de ORC.

        NOTA: In lipsa inregistrarii la ORC (persoane fizice romane, persoane fizice /juridice straine), sunt acceptate documente echivalente care sa dovedeasca o forma de inregistrare /atestare /apartenenta profesionala adecvate in raport cu obiectul contractului.

      1.În sit.în care mai multe oferte au fost declarate admisibile de catre autoritatea contractanta si sunt clasate pe primul loc si au si preturi egale A.C. va solicita clarificari prin intermediul SICAP in vederea incarcarii electronice de catre operatorii economici de noi documente care contin noi preturi. În cazul în care din motive tehnice exclusiv legate de performantele tehnice ale SICAP nu este posibila transmiterea în format electronic prin intermediul SICAP documentele respective se transmit AC în forma scrisa in plic sigilat .

      2. AC are dreptul de a solicita ofertantilor în circumstante exceptionale înainte de expirarea perioadei de valabilitate a ofertei prelungirea acestei perioade. În cazul extinderii perioadei de valabilitate a ofertei aceasta va fi prelungita în mod corespunzator. Ofertantul are obligatia de a comunica AC daca este sau nu de acord cu prelungiera perioadei de valabilitate a ofertei. Ofertantul care nu este de acord cu prelungirea perioadei de valabilitate a ofertei se considera ca si-a retras oferta fara ca acest fapt sa atraga pierderea garantiei de participare.

      3.Ofertantul va prezenta o declaratie prin care accepta clauzele contractuale cuprinse în modelul de contract din documentatia de atribuire. In sit. în care sunt obiectiuni la proiectul de contract respectiv modificari ale clauzelor contractuale sau adaugarea unor clauze noi, eventualele propuneri de modificare/completare/eliminare de clauze contractuale vor fi formulate în scris cu justificari si înaintate cu documentele de calificare. Daca propunerile sunt dezavantajoase pentru AC aceasta îsi rezerva dreptul de a le respinge informând ofertantul. Daca ofertantul nu renunta la aceste clauze AC va încadra oferta ca neconforma si o va respinge.

      4.In situatia in care ofertantul apeleaza la o asociere cu alti operatori, la terti sustinatori sau la subcontractanti, in afara documentelor solicitate expres la Cap. III.1.1 – Conditii de participare, in cuprinsul ofertei vor fi incluse si Angajament(e)+declaratii tert sustinator /accord asociere /declaratie privind partile din contract care se subcontracteaza, dupa caz, intocmite in conformitate cu prevederile legale si modelele din sectiunea Formulare.

      5.Numar zile pana la care se pot solicita clarificari inainte de data limita de depunere a ofertelor/candidaturilor: 18 zile. AC va raspunde in mod clar si complet tuturor solicitarilor de clarificare/informatii suplimentare, in a 11-a zi inainte de data limita de depunere a ofertelor.

      6.Semnarea contractului se va face la sediul Directiei Silvice Caras Severin, str. Petru Maior, nr. 69A, Resita, jud. Caras-Severin.
