        In conformitate cu art. 74 alin.3) din Legea 98/2016 privind achizitiile publice , cu modificarile si completarile ulterioare , autoritatea contractanta stabileste o perioada redusa pentru depunerea ofertelor, nu mai mica de 15 zile , datorita necesitatii stringente de a asigura activitatea de deszapezire a municipiului Galati, in conditii optime, si avand in vedere ca utilajele solicitate spre inchiriere, au facut obiectul altei proceduri ,in cadrul careia ori nu au fost depuse oferte ori ofertanti au depus documentele ofertei in mod eronat. Inchiriere de vehicule industriale cu sofer pentru servicii de deszapezire.

        estimari ale cantitatilor minime si maxime care ar putea fi solicitate pe durata întregului acord-cadru, precum si ale cantitatilor

        minime si maxime care ar putea face obiectul unui singur contract subsecvent dintre cele care urmeaza sa fie atribuite pe durata

        acordului-cadru: conform Caietului de sarcini.

        Autoritatea contractanta va raspunde in mod clar si complet tuturor solicitarilor de clarificare/informatiilor suplimentare in

  3. Section III
    1. Conditions for participation:
      1. Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers:
        List and brief description of conditions:

        1.Ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca în situatiile prevazute la art.164, 165, 167 din Legea nr.98/2016

        Modalitatea prin care poate fi demonstrata îndeplinirea cerintei: se va completa DUAE de catre operatorii economici participanti la procedurade atribuire cu informatiile aferente situatiei lor,. Documentele justificative care probeaza îndeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertanti clasati pe primele 3 de locuri/ lot în clasamentul

        intermediar întocmit la finalizarea evaluarii ofertelor. Aceste documente pot fi: 1.• certificate constatatoarevalabile la momentul prezentarii din care sa reiasa situatia operatorului economic , respectiv lipsa datoriilor la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat ( buget local; buget de stat, etc. ). 2.• cazierul judiciar al operatorului economic si al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic, sau a celor ce au putere de reprezentare, de decizie sau de control în cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC / actul constitutiv; 3.• dupa caz, documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166 alin. (2), art. 167 alin. (2), art. 171 din Legea 98/2016 privind achizitiile publice; 4.• alte documente edificatoare, dupa caz.

        Persoanele ce detin functii de decizie în cadrul Autoritatii Contractante cu privire la organizarea, derularea si finalizarea procedurii de atribuire sunt:

        Precizare: Ofertantul/Ofertantul asociat/tertul sustinator sau subcontractantul (daca este cazul), care are drept membri în cadrul consiliului de administratie/organ de conducere sau de supervizare si/sau are actionari ori asociati persoane care sunt sot/sotie, ruda sau afin pâna la gradul al patrulea inclusiv sau care se afla în relatii comerciale cu persoane ce detin functii de decizie în cadrul Beneficiarului sunt exclusi din procedura de atribuire.

        Daca apare o situatie de conflict de interese pe perioada derularii procedurii de achizitie, ofertantul are obligatia sa notifice in scris, de indata, entitatea care a organizat aceasta procedura si sa ia masuri pentru inlaturarea situatiei respective.

        Nota: Aceasta declaratie va fi prezentata de ofertant/membrii asocierii, de eventualii subcontractanti si terti sustinatori.

        - Certificat de atestare fiscala emis de Ministerul finantelor Publice, Directia Generala a Finantelor publice, valabile la momentul prezentarii din care sa reiasa situatia operatorului economic , respectiv lipsa datoriilor la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat ( buget local; buget de stat, etc. ). Documentele se vor prezenta original/copie legalizata/ copie lizibila cu mentiunea “conform cu originalul”, stampilata si semnata de reprezentantul legal . Se va completa DUAE- Ofertantii clasati pe primele trei locuri/ lot vor prezenta documentele. Ofertantii straini vor prezenta orice documente edificatoare, eliberate de autoritati competente din tara in care acestia sunt rezidenti, prin care sa dovedeasca indeplinirea obligatiilor scadente de plata a impozitelor catre bugetul de stat si bugetul local, in conformitate cu legislatia din tara de rezidenta.

Documentele se vor prezenta original/copie legalizata/ copie lizibila cu mentiunea “conform cu originalul”, stampilata si semnata de reprezentantul legal . Se va completa DUAE- Ofertantul clasat pe primul loc va prezenta documentele. Ofertantii straini vor prezenta orice documente edificatoare, eliberate de autoritati competente din tara in care acestia sunt rezidenti, prin care sa dovedeasca indeplinirea obligatiilor scadente de plata a impozitelor catre bugetul de stat si bugetul local, in conformitate cu legislatia din tara de rezidenta.

        Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de înregistrare în conditiile legii din tara de rezidenta, sa reiasa ca operatorul economic este legal constituit, ca nu se afla în niciuna dintre situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului. Modalitate prin care poate fi demonstrata îndeplinirea cerintei: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor.

        Se solicită ca ofertantul sa faca dovada detinerii utilajelor solicitate in Caietul de sarcini.ofertantul va prezenta, pentru fiecare lot pentru care depune oferta, o declaraţie privind dotarea cu vehiculele/utilajele necesare, care va cuprinde următoarele:- marca şi tipul vehiculului, utilajd) ofertantul va prezenta în propunerea tehnică:- copiile cărţilor de identitate sau certificatelor de înmatriculare sau a certificate de inregistrare, se va prezenta o declaratie privind starea de functionare a utilajelor- ofertantul va prezenta in cadrul ofertei tehnice o declaratie pe propria raspundere prin care declara ca in conditiile in care va fi desemnat castigator va prezenta asigurările obligatorii RCA, pana la data incheirerii contractului, pentru o eventuală despăgubire a maşinilor avariate, coparticipante în trafic, - copii ale contractelor de închiriere/asociere pentru vehiculele/utilajele care nu sunt proprietatea ofertantului, valabile pe toata perioada acordului cadru. In situatia in care oferantul nu detine in proprietate utilajele/ echipamentele respective, acesta va prezenta contracte/ precontracte de inchiriere sau comodat, sau angajamentul privind dotarea corespunzatoare, sau alte documente care sa faca dovada punerii la dispozitie a utilajelor si mijloacelor de transport pe intreaga durata a acordului–cadru. Se solicită ca ofertantul sa faca dovada detinerii utilajului, în funcţie de lotul pentru care prezinta oferta, pentru toata perioada de derulare a contractului.
