        Autoritatea contractantă va încheia un acord-cadru, cu un singur operator economic, pentru fiecare lot în parte, ce va avea ca obiect furnizarea de produse alimentare.

        Obiectul şi scopul acordului-cadru îl reprezintă stabilirea elementelor/condiţiilor esenţiale care vor guverna contractele subsecvente acestuia ce urmează a fi atribuite în temeiul şi pe durata derulării acestora.

        Achiziționarea produselor alimentare este necesară pentru hrănirea persoanelor private de libertate și are ca temei legal Ordinul nr. 3.147/C din 8 august 2018 privind aprobarea Normelor de acordare a drepturilor de hrană pentru persoanele private de libertate din sistemul administrației penitenciarelor.

        Autoritatea contractantă previzionează achiziționarea produselor în cantitățile minime și maxime, aceasta urmând atribuirea contractelor subsecvente acordului-cadru în funcție de necesități și de fondurile bugetare alocate.

        Durata acordurilor-cadru va fi de 12 luni.

        Cantitățile minime și maxime prevăzute în acordul-cadru sunt estimative.

        Prin contractele subsecvente ce vor fi încheiate între părți, cantitățile minime pot să nu fie atinse, cantitățile maxime pot fi depășite cu încadrarea valorică a suplimentării acordului-cadru în limita a 10%, fără a eluda prevederile Legii nr. 98/2016, cu modificările și completările ulterioare, care instituie obligații ale autorității contractante în raport cu anumite praguri valorice.

        Contractele subsecvente acordurilor-cadru se vor încheia lunar sau trimestrial ori de câte ori este necesar, în funcție de necesitățile autorității contractante.

        Numărul de zile în care se pot solicita clarificări înainte de data-limită pentru depunerea ofertelor este de 20 de zile.

        Autoritatea contractantă va răspunde în mod clar și complet tuturor solicitărilor de clarificări/informații suplimentare în a 15-a zi înainte de data-limită stabilită pentru depunerea ofertelor.
