Section III
1. Conditions for participation:
  1. Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers:
    List and brief description of conditions:
    Cerinta 1 - Ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca în situatiile prevazute la art.164, 165, 167 din Legea nr.98/2016.
    
    NOTA: Cerinta trebuie indeplinita de catre toti participantii la procedura (in calitate de ofertant unic, ofertant asociat, tert sustinator sau subcontractant). Modalitatea prin care poate fi demonstrata îndeplinirea cerintei: se va completa DUAE (Documentul Unic de Achizitie European) de catre ofertant/ofertant asociat/tert sustinator/ subcontractant, cu informatiile aferente situatiei lor. Documentele justificative care probeaza îndeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantii clasati pe primele trei locuri in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor intrucat ofertantii clasati pe primele trei locuri nu sunt si semnatarii contractului.
    
    Aceste documente pot fi:
    
    1. Certificate constatatoare privind lipsa datoriilor cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat (buget local, buget de stat, etc) valabile la momentul prezentarii. Certificatul privind plata taxelor si impozitelor locale vor fi prezentate pentru sediul societatii iar pentru toate punctele de lucru/sediile secundare va da o declaraţie pe propria răspundere privind îndeplinirea obligaţiilor de plată a impozitelor, taxelor sau contribuţiilor la bugetul general consolidat datorate.
    
    2. Cazierul judiciar al operatorului economic si al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic, sau a celor ce au putere de reprezentare, de decizie sau de control în cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC / actul constitutiv dupa caz, documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166 alin.(2), art. 167 alin. (2), art. 171 din Legea 98/2016 privind achizitiile publice;
    
    3. Declaratie privind evitarea conflictului de interese pentru ofertantul unic/ofertantul asociat/ subcontractantul/tertul sustinator (Declaratie privind neincadrarea in prev. Art. 59 si art. 60 din Legea nr.98/2016). Declaratia se va prezenta odata cu DUAE de catre toti participantii la procedura de atribuire (ofertant,asociat,subcontractant si tert sustinator).
    
    Conform art.63, alin. (1) din Legea nr.98/2016 coroborat cu art.21, alin.(5) din HG nr.395/2016, persoanele cu functie de decizie din cadrul autoritatii contractante, in ceea ce priveste organizarea, derularea si finalizarea procedurii de atribuire, sunt:

    Nota 2. Autoritatea contractanta are obligatia de a accepta ca fiind suficient si relevant pentru demonstrarea faptului ca ofertantul/candidatul nu se încadreaza în una dintre situatiile prevazute la art. 164, 165 si 167 din Legea 98/2016, orice document considerat edificator, din acest punct de vedere, în tara de origine sau în tara în care ofertantul/candidatul este stabilit, cum ar fi certificate, caziere judiciare sau alte documente echivalente emise de autoritati competente din tara respectiva. În cazul în care în tara de origine sau în tara în care este stabilit ofertantul/candidatul nu se emit documente cum ar fi certificate, caziere judiciare sau alte documente echivalente emise de autoritati competente din tara respectiva sau respectivele documente nu vizeaza toate situatiile prevazute la art. 164, 165 si 167, autoritatea contractanta are obligatia de a accepta o declaratie pe propria raspundere sau, daca în tara respectiva nu exista prevederi legale referitoare la declaratia pe propria raspundere, o declaratie autentica data în fata unui notar, a unei autoritati administrative sau judiciare sau a unei asociatii profesionale care are competente în acest sens.
    
    Documentele justificative care probeaza îndeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantii clasati pe primele trei locuri in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor intrucat ofertantii clasati pe primele trei locuri nu sunt si semnatarii contractului.
    
    Cerinta nr. 1
    
    Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de inregistrare in conditiile legii din tara de rezidenta, sa reiasa ca operatorul economic este legal constituit, ca nu se afla in niciuna dintre situatiile de anulare a constituirii, precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului.
    
    Modalitate de indeplinire: se va completa si prezenta DUAE (Documentul Unic de Achizitie European) de catre ofertant/ofertant asociat/tert sustinator/ subcontractant, cu informatiile aferente situatiei lor, urmând ca documentul justificativ, respectiv certificat constatator emis de O.N.R.C. (Oficiul National al Registrului Comertului) sau pentru ofertantii straini, document echivalent emis în tara de rezidenta, sa fie prezentat, la solicitarea autoritatii contractante, doar de catre ofertantii clasati pe primele trei locuri in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor intrucat ofertantii clasati pe primele trei locuri nu sunt si semnatarii contractului.
    
    Nota : Potrivit prevederilor art.193 din Legea 98/2016, autoritatea contractanta va accepta in cadrul ofertelor DUAE (Documentul Unic de Achizitie European) in locul documentelor solicitate in vederea demonstrarii cerintelor de calificare, inclusiv a capacitatii de exercitare, ca dovada preliminara.
    
    Cerinta nr. 2
    
    Operatorii economici ce depun oferta trebuie sa detina Aviz de funcționare eliberat de Ministerul Sănătații in confomitate cu art. 926, Legea 95/2006 privind reforma in domeniul sanatatii din care sa reiasa ca ofertantul este autorizat in vederea importului, distributiei dispozitivelor medicale ofertate, aviz în care trebuie să se regăsească producătorul dispozitivelor medicale care fac obiectul achiziției, completand in acest sens in DUAE.
    
    Pentru persoane juridice straine se solicita documente echivalente, emise in conformitate cu legislatia aplicabila in tara de rezidenta, in care sa se precizeze locul in care este valabila. Modalitatea prin care poate fi demonstrata indeplinirea cerintei: Se va completa DUAE de catre operatorii economici participanti la procedura de atribuire, cu informatiile aferente situatiei lor.
