        Completare DUAE referitor la neincadrarea ofertantului (lider, asociat, tert sustinator sau subcontractant) in situatiile prevazute de

        art. 164,165 si 167 din Legea nr. 98/2016.

        La finalizarea evaluarii ofertelor autoritatea contractanta are dreptul sa solicite ofertantilor clasati pe primele trei locuri,

        documente justificative din care sa reiasa aspectele precizate in DUAE.

        In conformitate cu prevederile sectiunii 8 din Legea 98/2016 autoritatea contractanta accepta ca operatorii sa transmita in SEAP

        declaratia pe propria rãspundere actualizatã DUAE (formular care se completeaza direct in SEAP), pana la data limita de depunere a

        ofertelor.

        Documentele justificative privind cerintele de calificare care vor putea fi solicitate de autoritatea contractanta ofertantilor clasati pe

        primele trei locuri in clasamentul intermediar la finalizarea evaluarii ofertelor, pot fi: a)pentru sediul principal certificate fiscale cu privire la plata impozitelor,

        taxelor sau a contributiilor la bugetul general consolidat (buget local, buget de stat etc.) valabile la momentul prezentarii, iar pentru sediile secundare/punctele

        de lucru, se va prezenta o declaraţie pe propria răspundere;

        b) cazierul judiciar al operatorului economic si al membrilor organului de administrare,

        de conducere sau de supraveghere al respectivului operator economic, sau a celor ce au putere de reprezentare, de decizie sau de

        control în cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC / actul constitutiv; c) dupa caz, documente prin

        care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166 alin.(2), art. 167 alin. (2), art.

        171 din Legea 98/2016 privind achizitiile publice; d) alte documente edificatoare, dupa caz.

        Ofertantul trebuie sa respecte regulile de evitare a conflictului de interese conform capitolului 2 sectiunea 4 din legea nr. 98/2016.

        Certificat Constatator emis de Oficiul Registrului Comertului în copie “conform cu originalul” semnat si stampilat de reprezentantul

        legal.

        Din acest document trebuie sa rezulte obiectul de activitate al respectivului operator economic.

        Obiectul contractului trebuie sa aiba corespondent în codul CAEN din certificatul constatator emis de ONRC.

        Pentru persoane juridice/fizice straine: documente edificatoare care sa dovedeasca o forma de înregistrare ca persoana

        juridica/fizica sau de înregistrare/atestare ori apartenenta din punct de vedere profesional, în conformitate cu prevederile legale din

        tara în care ofertantul este rezident.

        Informatiile cuprinse in Certificatul constatator trebuie sa fie valabile/reale la data prezentarii documentului.

        Operatorii economici au obligatia de a completa DUAE in SEAP numai pana la data si ora limita prevazute in

        anuntul de participare urmand ca documentele justificative care probeaza

        îndeplinirea celor asumate prin completarea DUAE, respectiv certificat constatator emis de ONRC, sau în cazul ofertantilor straini,

        documente echivalente emise în tara de rezidenta, sa fie prezentate, la solicitarea autoritatii contractante, doar de catre ofertantii

        clasati pe primele trei locuri în clasamentul intermediar, întocmit la finalizarea evaluarii ofertelor.
