                        Toate raspunsurile la solicitarile de clarificari cerute de operatorii economici sau formulate de autoritatea contractanta/decizii CNSC/contestatii/note de informare/masuri de remediere vor fi postate pe site-ul www.e-licitatie.ro la rubrica Documentatii/clarificari/Decizii, precum si prin publicarea de erate.

                        De fiecare dată când intenţionează să atribuie un contract de achiziţie publică subsecvent unui acord-cadru, autoritatea contractantă va solicita operatorului contractant semnarea contractului subsecvent, conform prevederilor ofertei.

                        In cazul in care operatorul economic aflat in prima pozitie din clasament nu poate furniza intreaga cantitate de produse necesara si/sau nu poate respecta termenele de livrare, atunci autoritatea contractanta are dreptul de a transmite solicitare in vederea atribuirii contractului subsecvent celui de-al doilea operator economic aflat in clasamentul intocmit in baza preturilor ofertate pentru lotul respectiv. Se va proceda in consecinta si daca cel de-al doilea, nu poate furniza intreaga cantitate de produse necesara si/sau nu poate respecta termenele de livrare trimitandu-se solicitare in vederea atribuirii contractului subsecvent urmatorului clasat, cu care autoritatea contractanta a incheiat acord – cadru.

                        In cazul in care, vor fi depuse oferte cu valori egale, modalitatea de departajare a ofertelor clasate pe locurile 1, 2 si 3 se va realiza prin transmiterea unei solicitari de clarificare din partea autoritatii contractante prin intermediul facilitatii existente in SEAP, la care operatorii economici vor transmite noile valori, dar acestea din urma nu pot fi imbunatatite decat la nivelul ofertat de operatorul clasat pe locul anterior, care va fi prezentata prin intermediul SEAP.

                        Daca in urma reofertarii se mentine egalitate, departajarea se va face dupa data criptarii ofertei tehnice in SEAP.

                        Autoritatea contractanta isi rezerva dreptul de a denunta unilateral acordul cadru inainte de termen in cazul in care ASSM Bucuresti sau Ministerul Sanatatii va incheia in baza OUG 71/2012 acorduri cadru avand ca obiect produsele din prezenta procedura.

                        Solicitarile de clarificari referitoare la prezenta documentatie de atribuire se vor adresa in mod exclusiv in SEAP la sectiunea „Intrebari” din cadrul procedurii de atribuire derulate prin mijloace electronice, iar raspunsurile la acestea vor fi publicate in SEAP la sectiunea „Documentatie, clarificari si decizii” din cadrul anuntului/invitatiei de participare, autoritatea contractanta urmand sa nu dea curs solicitarilor adresate prin alta modalitate de comunicare decat cea stabilita.

                        Documentelor transmise prin mijloace electronice le sunt aplicabile prevederile legale referitoare la semnătura electronică (Legea nr. 455/2001, cu modificările și completările ulterioare). Astfel, documentele ofertei, DUAE, documentele de calificare, orice alte documente justificative, precum şi, după caz, răspunsurile la solicitările de clarificări, se transmit conform solicitării AC, prin intermediul SEAP, în mod obligatoriu semnate cu semnătura electronică extinsă, bazată pe un certificat calificat, eliberat de un furnizor de servicii de certificare acreditat, fiind considerate documente originale. Documentele emise de instituţii/ organisme oficiale abilitate trebuie să fie semnate şi parafate conform prevederilor legale, urmând ca semnătura electronică extinsă, bazată pe un certificat calificat, eliberat de un furnizor de servicii de certificare acreditat, aparţinând OE să fie aplicată de acesta asupra copiei respectivului document.

                        DUAE va fi completat conform Instructiunilor prezentate in anexa nr. 1 din Ordinul Presedintelui ANAP nr.1017/ 2019.

                        Datele cu caracter personal solicitate în prezenta procedură, sunt prelucrate în conformitate cu prevederile Regulamentului nr.679/2016. Scopul prelucrării datelor cu caracter personal este cel stabilit de îndeplinirea obligațiilor instituite de legislatia privind achizițiile publice, iar durata de prelucrare a acestora este perioada derulării procedurii, cât și cea ulterioră acesteia, în conformitate cu actele normative in vigoare.

                        ”Cerintele tehnice definite la nivelul anuntului de participare, caietului de sarcini sau altor documente complementare, prin trimiterea standardelor, la un anumit producator, la marci, brevete, tipuri, la o origine sau la o productie/metoda specifica de fabricatie/prestare/executie, vor fi intelese ca fiind insotite de mentiunea ”sau echivalent”.

                        ATENŢIE: Pentru a fi declarată conformă, oferta trebuie să respecte fiecare cerinţă minimă şi obligatorie, specificată ca atare în caietul de sarcini.
