  3. Section III
    1. Conditions for participation:
      1. Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers:
        List and brief description of conditions:

        1)Ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca in situatiile prevazute la art. 164, 165, 167 din Legea nr. 98/2016. Modalitatea prin care poate fi demonstrata indeplinirea cerintei: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul 1 in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor. Aceste documente pot fi:

        a) certificate constatatoare privind lipsa datoriilor restante cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat (buget local, buget de stat, etc.), valabile la momentul prezentarii.

        b) Cazierul judiciar al operatorului economic si al membrilor organului de administrare, de conducere sau supraveghere al respectivului operator economic, sau a celor ce au putere de reprezentare, de decizie sau de control in cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC/actul constitutiv, valabile la momentul prezentarii.

        c) Dupa caz, documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art.166 alin (2), art. 167 alin. (2), art. 171 din Legea 98/2016 privind achizitiile publice.

        d) Declaratie privind neincadrarea in prevederile art. 59 din Legea nr 98/2016 privind achizitiile publice (evitarea conflictului de interese)-Informatii privind personalul autoritatii contractante care sunt implicate în desfasurarea procedurii de atribuire:

        Se va completa DUAE, urmand ca documentele justificative care demonstreaza cele asumate prin DUAE sa fie prezentate doar de catre ofertantul clasat pe primul loc in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor, la solicitarea autoritatii contractante.

        Se vor depune, odata cu DUAE, urmatoarele documente: angajamentul ferm al tertului sustinator din care rezulta modul efectiv in care se va materializa sustinerea acestuia, a acordului de subcontractare si/sau a acordului de asociere, dupa caz.

        1. Persoane juridice/fizice române: Certificat Constatator eliberat de Oficiul National al Registrului Comertului din care sa reiasa ca operatorii economici ce depun oferta trebuie sa dovedeasca o forma de inregistrare in conditiile legii din tara de rezidenta, sa reiasa ca operatorul economic este legal cosntituit, ca nu se afla in niciuna dintre situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatile ce fac obiectul contractului.

        În cazul unei asocieri, fiecare asociat este obligat sa prezinte acest document.

Pentru persoane juridice/fizice străine: - Documente care dovedesc o forma de înregistrare/atestare ori apartenţa din punct de vedere profesional, în conformitate cu prevederile legale din ţara în care ofertantul este rezident (documentele vor fi prezentate în copie certificată „conform cu originalul”, semnate şi ştampilate de reprezentantul legal şi traducerea autorizată în limba romană).

      Cerintele tehnice definite la nivelul anuntului de participare, caietului de sarcini sau altor documente complementare, prin trimiterea standardelor, la un anumit producator, la marci, brevete, tipuri, la o origine sau la o productie/metoda specifica de fabricatie/prestare/executie, vor fi intelese ca fiind insotite de mentiunea ”sau echivalent”.In cazul in care exista oferte clasate pe primul loc care prezinta un pret egal, se va solicita reofertare printr-o clarificare inaintata ofertantului, iar ofertantii vor depune o noua oferta in SEAP, in urma solicitarii de clarificari formulate de catre autoritatea contractanta. Analiza documentelor prezentate de ofertantii de catre comisia de evaluare nu angajeaza din partea acesteia nici o raspundere sau obligatie fata de acceptarea ca fiind autentice sau legale si nu inlatura raspunderea exclusiva a ofertantului sub acest aspect.
