        1. In cazul in care in urma stabilirii clasamentului final conform criteriului de atribuire, comisia de evaluare constata ca sunt doua sau mai multe oferte, clasate pe locul I, II, III, cu acelasi pret, autoritatea contractanta va solicita operatorilor economici in cauză, o noua propunere financiara, prin intermediul SEAP, pe baza careia vor fi departajati. Operatorii economici in cauza vor depune prin intermediul SEAP,o noua propunere financiara (documentele care contin noile preturi), pe baza careia vor fi departajati. In cazul ofertelor financiare egale de pe pe pozitiile 2, 3, Noua propunere financiara NU trebuie sa afecteze pozitiile superioare din clasament art.138 alin (3) din Legea nr.98/2016
        
        2.In cazul in care operatorul economic demonstreaza indeplinirea criteriilor referitoare la situatia personala a ofertantului, capacitatea de exercitare a activitatii profesionale, capacitatea economica si financiara, capacitatea tehnica si profesionala si standarde de asigurare a calitatii si de protectie a mediului invocand sustinerea unui tert, sau in cazul in care operatorul economic intentioneaza sa subcontracteze o parte/parti din contract, DUAE include si informatiile cu privire la subcontractanti sau la tertii care asigura sustinerea.
        
        3.Operatorul economic va preciza lista documentelor din oferta care sunt confidentiale, protejate de un drept de proprietate intelectuala sau secret comercial.
        
        4. Prezentul acord cadru poate inceta in situtatia in care produsele nominalizate fac obiectul unui acord cadru/contract semnat in urma organizarii licitatiei centralizate conform OUG 71/20.11.2012 sau a unui act normativ similar, cu notificare prealabila de 5 zile.
