            1. Additional information

              DUAE va fi configurat de catre autoritatea contractanta direct in SEAP la definirea documentatiei de atribuire. Operatorii economici care participa la procedura vor completa direct in SEAP, in sectiunea dedicata a procedurii de interes, DUAE-ul deja configurat de autoritatea contractanta.

              Detalii cu privire la intocmirea DUAE se vor regasi, dupa autentificarea in sistem, in sectiunea „Informatii DUAE” – Ghid de completare DUAE.

              Raspunsurile la solicitarile de clarificari se vor posta in SEAP la sectiunea ”Raspuns consolidat”, a anuntului de participare publicat pe site –ul www.e-licitatie.ro. Comisia de evaluare va transmite solicitarile de clarificare privind ofertele depuse, in SEAP la Sectiunea “Intrebari”. Operatorii economici vor transmite raspunsurile la clarificari si eventualele documente solicitate pe parcursul evaluarii ofertelor prin intermediul SEAP (Sectiunea “Intrebari”), integral in sectiunea corespunzatoare respectivei solicitari, sub forma unuia sau a mai multor documente/fisiere distincte semnate cu semnatura electronica.

              In cazul in care in urma stabilirii clasamentului final conform criteriului de atribuire, ofertele clasate pe primul loc au preturi egale, comisia de evaluare va solicita clarificari prin intermediul SEAP, in vederea incarcarii electronice de catre operatorii economici de documente care contin noi preturi. In cazul in care egalitatea ofertelor se mentine autoritatea contractanta solicita din nou reofertarea pretului, iar in cazul in care dupa rereofertare preturile vor fi egale procedura se va anula. Nota: functie de situatia concreta, autoritatea contractanta va aplica corespunzator prevederile art.138 alin 1 si 2 din Anexa la H.G. nr.395/2016.

              Cerintele tehnice definite la nivelul anuntului de participare, caietului de sarcini sau altor documente complementare, prin trimiterea standardelor, la un anumit producator, la marci, brevete, tipuri, la o origine sau la o productie/metoda specifica de fabricatie/prestare/executie, vor fi intelese ca fiind insotite de mentiunea ”sau echivalent”

              Continuare III.1.1.a) Situatia personala a candidatului sau ofertantului

              In cazul in care in tara de origine sau tara in care este stabilit ofertantul /subcontractantul nu se emit documente de natura celor prevazute mai sus, sau respectivele documente nu vizeaza toate situatiile prevazute la art.164, 165 si 167 din Legea nr. 98/2016, autoritatea contractanta are obligatia de a accepta o declaratie pe proprie raspundere sau, daca in tara respectiva nu exista prevederi legale referitoare la declaratia pe propria raspundere, o declaratie autentica data in fata unui notar, a unei autoritati administrative sau judiciare sau a unei asociatii profesionale care are competente in acest sens.

              Informatii privind asociatii:

              In cazul depunerii unei oferte comune, DUAE va fi completat de fiecare operator economic in parte.

              Se va prezenta Acordul de asociere (formularul nr. 2) cu urmatoarele prevederi minime:

              - asociatii sunt responsabili solidar si nelimitat de executarea contractului

              - nominalizarea liderului asocierii;

              - comunicarile se vor face cu liderul asocierii;

              Nominalizarea persoanei care semneaza in numele si din partea liderului, precum si imputernicirea de a semna contractul in numele asocierii.

              Nota: Autoritatea contractanta va solicita legalizarea asocierii in cazul in care oferta comuna este declarata castigatoare;

              - atunci cand un grup de operatori economici depune oferta comuna, capacitatea - economico - financiara, se demonstreaza prin luarea in considerare a resurselor tuturor membrilor grupului.

              Modalitate de indeplinire: DUAE aferent procedurii de atribuire este configurat de catre autoritatea contractanta direct in SEAP la definirea documentatiei de atribuire. Raspunsurile vor fi completate de operatorii economici direct in SEAP, dupa autentificare, tinand cont de calitatea in care acestia participa la procedura de atribuire cu informatiile aferente situatiei lor. Documentele justificative care probeaza indeplinirea celor asumate prin completare DUAE, urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe primul loc in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.

              Informatii privind partea/partile din contract pe care operatorul economic, are eventual, intentia sa o subcontracteze.

              Ofertantul are obligatia de a preciza partea/partile din contract care urmeaza sa le subcontracteze si datele de recunoastere ale subcontractantilor propusi.

              In cazul in care ofertantul utilizeaza capacitatile subcontractantului / subcontractantilor pentru a indeplini criteriile de calificare, se va prezenta cate un formular DUAE separat pentru fiecare dintre subcontractanti, completat si semnat in mod corespunzator de catre fiecare dintre acestia.

              Continuare III.1.1.b) Capacitatea de exercitare a activitatii profesionale

              Cerinta nr. 2

              Aviz de functionare emis de Ministerul Sanatatii (insotit de anexe), prin ANMDM, pentru activitatea de depozitare, distribuire si comercializare pentru categoria de produse ofertate – copie conform cu originalul – conform art. 926 din Legea nr.95/2006, Titlul XIX dispozitive medicale, modificata si actualizata, privind reforma in domeniul sanatatii, dupa caz.

              Modalitatea prin care poate fi demonstrata indeplinirea cerintei: se va completa DUAE (format xml) de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE, respectiv avizul emis de Ministerul Sanatatii, inclusiv anexele la acesta, valabile la data prezentarii acestui document, sau echivalentul acestui document in cazul ofertantilor straini, urmeaza a fi prezentate, la solicitarea autoritatii contractante doar de ofertantul clasat pe locul 1 in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor. Din aviz trebuie sa reiasa ca ofertantul este distribuitor/producator al produselor ofertate.

              Precizari:

              - in cazul unei oferte depuse in asociere, fiecare membru al asocierii trebuie da depuna documentele necesare pentru demonstrarea faptului ca este autorizat sa desfasoare partea sa din contract;

              - in cazul persoanelor juridice straine se solicita documente care dovedesc o forma de inregistrare / atestare ori apartenenta din punct de vedere profesional, conforme legii tarii de rezidenta a operatorului economic, insotite de traducerea acestora in limba romana de catre un traducator autorizat

              Cerinta nr. 3

              Autorizatia de distributie angro eliberata de Ministerul Sanatatii, prin ANMDM - Dovada avizarii unitatii pentru activitati de procurare/comercializare, activitati de detinere (depozitare)/manipulare, livrare/transport sub contract, a medicamentelor de uz uman prin prezentarea Autorizatiei de distributie angro eliberata de MS –ANMDM, in conformitate cu dispozitiile art. 800 alin. (1) din Legea nr. 95/2006 si ale art. 2 din normele la Ordinul nr. 131/2016 pentru aprobarea Normelor privind autorizarea unitatilor de distributie angro de medicamente de uz uman, certificarea de buna practica de distributie si inregistrarea brokerilor de medicamente de uz uman.

              Modalitate prin care poate fi demonstrata indeplinirea cerintei: se va complete DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE, respectiv autorizatia de distributie en-gros si APP-ul, sau in cazul ofertantilor straini, documente echivalente emise in tara de rezidenta, urmeaza sa fie prezentate, la solicitarea autoritatii contractante, numai de ofertantii clasati pe primul loc la finalizarea evaluarii ofertelor.

              Toate documentele trebuie sa fie valabile LA MOMENTUL PREZENTARII ACESTORA
