        Avand în vedere că autoritatea contractantă va semna acordul cadru cu primul operator economic clasat pe locul I în clasamentul întocmit după evaluarea ofertelor, modul de departajare a ofertelor cu prețuri egale, se va face astfel:
        
        - în cazul în care comisia constată că au fost depuse/introduse în SEAP cel puțin de 2 (două) oferte admisibile cu prețuri egale, autoritatea contractantă va solicita depunerea de noi propuneri financiare îmbunătățite, cu 2 (două) zecimale, iar operatorii vor transmite răspunsul lor folosind SEAP. Acordul cadru va fi semnat cu operatorul economic ce va avea prețul cel mai scăzut.
        
        - în cazul păstrării egalității și după solicitarea de clarificări referitoare la depunerea de noi propuneri financiare îmbunătățite în SEAP, procedura pentru lotul/loturile respective se anulează.
        
        - noile propuneri financiare se vor posta în SEAP, iar termenele de depunere ale acestora se vor comunica în solicitarea transmisă de către autoritatea contractantă.
        
        - câștigătorul va fi desemnat prin aplicarea criteriului – prețul cel mai scăzut.
        
        - se va semna un acord cadru pentru fiecare lot în parte indiferent dacă unui singur ofertant îi este atribuit un lot sau mai multe.
        
        Operatorii economici participanți la procedura de atribuire (candidat, ofertant, terț susținător, subcontractant), au obligația de a completa DUAE, instituit la nivelul U.E, prin Regulamentul CE nr. 7/2016, care se poate descărca de la https://ec.europa.eu/growth/tools-databases/espd/filter.
