    Acord cadru de servicii – amenajarea și întreținerea zonelor verzi din Municipiul Arad – obiectivele III și V – 2 loturi.
    
    Lot I - OBIECTIVUL III și Lot II - OBIECTIVUL V, conform cerinţelor caietului de sarcini.
    
    Acord - cadru de servicii pe 4 ani, în executarea căruia se vor atribui contracte subsecvente, minim un contract subsecvent pe an, cu încadrare în alocările bugetare. Cantitățile minime și maxime, anuale și aferente întregului acord cadru se regăsesc în caietul de sarcini.
    
    Având în vedere necesitatea întreținerii spațiilor verzi existente pe raza Municipiului Arad prin prin lucrări specifice acestui serviciu și anume:
    
    - degajare pentru eliminarea deșeurilor de pe spațiile verzi, cosit iarbă, toaletat/tăiat arbori și arbuști, mobilizat teren, executat plantări de arbori arbuști, flori etc,
    
    - amenajări de noi spații verzi și reabilitarea celor existente,
    
    - necesitatea achiziționării de materiale dendrofloricole necesare pentru amenajarea spațiilor verzi existente cât și pentru amenajarea unor noi spații verzi,
    
    - necesitatea asigurării necesarului optim de apă pentru menținerea în vegetație atât a arborilor tineri cât și a trandafirilor, florilor arbuștilor având în vedere temperaturile ridicate din timpul verii,
    
    - necesitatea marcării arborilor în vederea tăierii cât și întocmirea documentelor pentru punerea în valoare a materialului lemnos rezultat.
    
    Valoarea estimată a acordului cadru obiectivul III– Lot I: între 3.464.467,12 lei fără TVA și 22.089.974,88 lei fără TVA
    
    Valoarea estimată a acordului cadru obiectivul V – Lot II: între 2.277.360,12 lei fără TVA și 25.298.395,52 lei fără TVA
    
    Autoritatea contractanta va raspunde solicitarilor de clarificare adresate in termenul prevazut la sectiunea I.3 (cu 12 zile inainte de data limita stabilita pentru depunerea ofertelor) cu 10 zile inainte de data limita stabilita pentru depunerea ofertelor, astfel incat sa se respecte prevederile art. 20-21 din OUG 107/2017

        În cazul ofertelor clasate pe primul loc, având aceeași valoare ofertată, departajarea ofertanţilor se va face prin reofertarea propunerii financiare.
        
        Conform art 123 din HG 395/2016, ofertantul va indica în cuprinsul ofertei care informatii din propunerea tehnica si/sau din propunerea financiara sunt confidentiale, clasificate sau sunt protejate de un drept de proprietate intelectuala. Având în vedere Legea 184/2016 privind instituirea unui mecanism de prevenire a conflictului de interese în procedura de atribuire a contractelor de achiziție publică, ofertantii vor completa formularul „Anexa informatii ANI”, formular ce se regaseste in Sectiune „Formulare”. Acesta se va completa pentru fiecare persoană cu putere de decizie așa cum rezultă din certificatul eliberat de ONRC.
        
        DUAE este pus la dispozitia ofertantilor in format editabil (document word) si se regaseste ca FORMULAR (DUAE.doc) in documentatia de atribuire aferenta prezentului anunt de participare (conform notificarilor ANAP nr. 237 si 240 din 2016 si a notificarii FN/01.09.2016). Pentru completarea DUAE se va accesa sectiunea Formulare – DUAE.
        
        În conformitate cu prevederile art. 107 din Hotărârea Guvernului nr. 395/2016 coroborat cu prevederilor art. 118 din Legea nr. 98/2016, autoritatea contractantă a optat în a încheia pentru prestarea serviciilor de amenajare și întreținerea zonelor verzi din Municipiul Arad – obiectivele III și V – 2 loturi acord cadru cu un singur operator şi cu o durată de 4 ani - deoarece serviciile vor fi prestate în baza unor comenzi emise de compartimentul de specialitate, în funcţie de necesităţile constatate. Acest lucru presupune că solicitările de servicii de amenajare și întreținerea zonelor verzi din Municipiul Arad pot varia semnificativ ca tip și cantitate pe parcursul unui an calendaristic. Astfel, s-a ales modalitatea specială de atribuire a acordului-cadru, deoarece permite încheierea contractelor subsecvente asigurând astfel prestarea serviciilor în orice moment.
        
        Obiectul acordului–cadru ce se intenţionează a fi încheiat este identic cu cel al contractului subsecvent mai-sus menţionat.
