        Activitatea de service reprezintă efectuarea lunara/trimestriala/semestriala a operaţiunilor de întreţinere planificate, conform recomandărilor producătorilor si remedierea tuturor defecţiunilor accidentale apărute (la solicitarea beneficiarului) la dispozitivele si echipamentele medicale.

        Detalierea operatiunilor ce trebuiesc efectuate este redactata in caietul de sarcini. Periodicitatea efectuarii operatiunilor si echipamentele medicale carora li se vor efectua aceste interventii reprezinta informatii detaliate in anexa la caietul de sarcini - document atasat la prezenta procedura de achizitii.

        Orice operator economic interesat are dreptul de a solicita clarificari sau informatii suplimentare in legatura cu documentatia de atribuire, cu respectarea termenului limita stabilit de autoritatea contractanta in instructiunile catre ofertanti/candidati - Sectiunea Comunicare, respectiv numarul de zile pana la care se pot solicita clarificari inainte de data limita de depunere a ofertelor/candidaturilor: 15 zile.

        Raspunsurile la solicitarile de clarificari cu privire la documentatia de atribuire vor fi publicate în SEAP, la Sectiunea ”Lista clarificari, notificari si decizii” din cadrul anuntului de participare .

        Autoritatea contractanta va raspunde tuturor solicitarilor de clarificari/ informatii suplimentare, in a 11-a zi inainte de termenul stabilit pentru depunerea ofertelor, conform art. 161 din Legea 98 /2016.

                            1.Modul de departajare al ofertelor: avand in vedere ca acordul cadru se încheie cu un numar maxim de 3 operatori economici, criteriul de atribuire fiind pretul cel mai scazut, modalitatea de departajare a eventualelor oferte cu preturi egale clasate pe unul dintre primele 3 locuri ale clasamentului va fi reofertarea. Reofertarea se va realiza prin incarcarea electronica in SEAP de documente care contin noile preturi. Pretul reofertat nu poate fi îmbunatatit decât pâna la nivelul pretului ofertat de operatorul clasat pe locul anterior.

                            2. DUAE se completeaza de catre ofertanti direct in SEAP.

                            3. Toate documentele vor fi semnate obligatoriu cu semnatura electronica EXTINSA a semnatarului pana cel tarziu la ora si data mentionata in anuntul de participare.

                            4.Conform prevederilor Art. 1276 din Codul Civil, Autoritatea contractanta isi rezerva dreptul de a denunta unilateral acordul cadru, printr-o notificare scrisa, fara nici o compensatie, de la data la care aceasta incheie contractele subsecvente la acordurile-cadru incheiate de Ministerul Sanatatii, Oficiul National pentru Achizitii Centralizate sau orice alta institutie cu atributii in efectuarea achizitiilor centralizate, in calitate de unitate centralizata de achizitii. In acest caz, furnizorul are dreptul de a pretinde numai plata corespunzatoare pentru partea din contract/acord cadru/contract subsecvent indeplinita pana la data denuntarii unilaterale.

                            ”Cerintele tehnice definite la nivelul anuntului de participare, caietului de sarcini sau altor documente complementare, prin trimiterea standardelor, la un anumit producator, la marci, brevete, tipuri, la o origine sau la o productie/metoda specifica de fabricatie/prestare/executie, vor fi intelese ca fiind insotite de mentiunea ”sau echivalent”.
