    1. Conditions for participation:
      1. Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers:
        List and brief description of conditions:

        1. Operatorii economici nu trebuie sa se regaseasca in situatiile prevazute la art.164,165, 167 din Legea nr. 98/2016 .

        Modalitatea de deplinire a cerintei: “Completare DUAE” de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. urmand ca la finalizarea evaluarii ofertelor autoritatea contractanta sa solicite ofertantului clasat pe primul loc urmatoarele documente justificative:

        a) Certificat fiscal emis de ANAF care sa ateste lipsa datoriilor restante la momentul depunerii.

        b) Certificat taxe si impozite locale care sa ateste lipsa datoriilor restante la momentul depunerii. Nota: In situatia existentei mai multor puncte de lucru, cerinta privind taxele si impozitele locale se va aplica cel putin pentru punctul /punctele de lucru implicate in derularea contractului.

        c) dupa caz, documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166 alin. (2), art. 167 alin. (2), art. 171 din Legea 98/2016 privind achizitiile publice;

        d)Cazierul judiciar al operatorului economic si al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic, sau a celor ce au putere de reprezentare, de decizie sau de control în cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC / actul constitutiv; -alte documente edificatoare, dupa caz.

        e) alte documente edificatoare, dupa caz.

        2. Persoanele cu functie de decizie din cadrul autoritatii contractante implicate in procedura de achizitie publica sunt:

        Director - ing. Oprea Ioan, Director tehnic – ing. Lombrea Traian, Director economic - ec. Rusu Carina, jurist – Garjoaba Eugen, resp. Achiziţii – ing. Dragu Marian, resp. mecanizare – ing. Jichici Daniel.

        - DECLARATIE PRIVIND neincadrarea in prevederile art. 60 din Legea 98/2016. Operatorul economic (lider, asociat, tert sustinator,subcontractant) va completa cerinta corespunzatoare in DUAE . Documentul justificativ se depune de catre toti participantii la procedura (operator economic care depune oferta in mod individual sau in asociere, subcontractant sau tert sustinator ) odata cu DUAE pana la termenul limita de depunere a ofertelor.”

        Cerinta nr.1

        Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de inregistrare in conditiile legii din tara de rezidenta, sa reiasa ca operatorul economic este legal constituit, ca nu se afla in niciuna dintre situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului.

        Modalitatea de deplinire a cerintei: “Completare DUAE” de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor, urmand ca la finalizarea evaluarii ofertelor autoritatea contractanta sa solicite ofertantului clasat pe primul loc urmatoarele documente justificative:

        - Certificat constatator eliberat de Oficiul Registrului Comertului, sau in cazul ofertantilor straini, documente echivalente emise in tara de rezidenta, urmeaza sa fie prezentate numai la solicitarea autoritatii contractante. Informatiile cuprinse in documentele justificative trebuie sa fie reale/valide la data prezentarii acestora. Pentru persoane juridice/fizice straine documentele care dovedesc o forma de inregistrare / atestare vor fi prezentate in traducere in limba romana.

        Cerinta nr.2

        Ofertantii trebuie sa dovedeasca faptul ca au un punct de lucru autorizat tehnic, minim clasa a II-a, de catre Registrul Auto Roman in judetul Timis.

        Modalitatea de deplinire a cerintei: “Completare DUAE” de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor, urmand ca la finalizarea evaluarii ofertelor autoritatea contractanta sa solicite ofertantului clasat pe primul loc urmatoarele documente justificative:

        - Autorizaţie tehnică minim clasa a II-a emisă Registrul Auto Român, valabilă la data depunerii, în copie lizibila cu mentiunea „conform cu originalul“, conform Ordonantei de Guvern nr. 82/2000 cu modificarile si completarile ulterioare.

        Cerinta nr.3

        Ofertantii trebuie sa dovedeasca faptul ca au un punct de lucru autorizat ITP, de catre Registrul Auto Roman in judetul Timis.

        Modalitatea de deplinire a cerintei: “Completare DUAE” de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor, urmand ca la finalizarea evaluarii ofertelor autoritatea contractanta sa solicite ofertantului clasat pe primul loc urmatoarele documente justificative:

        - Autorizaţie pentru ITP emisă de Registru Auto Român, valabilă la data depunerii, în copie lizibila cu mentiunea „conform cu originalul“, conform Ordonantei de Guvern nr. 82/2000 cu modificarile si completarile ulterioare.
