    1. Conditions for participation:
      1. Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers:
        List and brief description of conditions:

        1.Ofertantii nu trebuie sa se regaseasca in situatiile prevazute la art. 164, 165, 167 si art. 59 din Legea nr. 98/2016 privind achizitiile publice.

        Operatorul economic (lider, asociat, tert sustinator, subcontractant) va completa cerinta corespunzatoare in formularul DUAE, cu informatii

        aferente situatiei lor, din documentatia de atribuire. Incadrarea in situatia prevazuta la art. 164, 165, 167 din Legea nr. 98/2016 privind

        achizitiile publice atrage exluderea ofertantului din procedura aplicata pentru atribuirea contractului de achizitie publica. Documentele

        justificative care probeaza indeplinirea celor asumate prin completarea formularului DUAE trebuie prezentate, DOAR LA SOLICITAREA

        AUTORITATII CONTRACTANTE, numai de ofertantii clasati pe primele trei locuri la finalizarea evaluarii ofertelor.

        Aceste documente pot fi:

        Persoane juridice/fizice romane:

        -CERTIFICAT DE ATESTARE FISCALA pentru persoane juridice, eliberat de MFP sau subunitatile subordonate care au calitatea de creditor

        bugetar (din acest certificat trebuie sa reiasa ca ofertantul nu are datorii restante la MOMENTUL prezentarii acestora);

        -CERTIFICAT DE ATESTARE FISCALA privind impozitele si taxele locale in cazul persoanelor juridice, eliberat de Consiliul Local (din acest

        certificat trebuie sa reiasa ca ofertantul nu are datorii restante la MOMENTUL prezentarii acestora);

        -CAZIER JUDICIAR al operatorului economic si al membrilor organului de administrare, de conducere sau de supraveghere al operatorului

        economic, sau a celor ce au putere de reprezentare, de decizie sau de control in cadrul acestuia, asa cum rezulta din certificatul constatator

        emis de ORNC sau actul constitutiv. Modalitate de indeplinire: completare DUAE.

        Persoane juridice/fizice straine:

        Documente edificatoare, eliberate de autoritati competente din tara in care acestia sunt rezidenti, prin care sa dovedeasca indeplinirea

        obligatiilor scadente de plata a impozitelor catre bugetul de stat si bugetul local, in conformitate cu legislatia din tara de rezidenta.

        Documentele se vor prezenta insotite de traducerea autorizata a acestora in limba romana.

        Dupa caz, documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogari prevazute la art. 166 alin. (2),

        art. 167 alin (2), art. 171 din Legea nr. 98/2016 privind achizitiile publice.

        Dupa caz, alte documente edificatoare.

        2 Document semnat si stampilat din care sa rezulte faptul ca ofertantul si asociatul/subcontractantul/tertul sustinator (dupa caz) nu se

        incadreaza in situatiile privind conflictul de interese prevazute la art.59 si art 60 din Legea nr. 98/2016.Documentul se ataseaza in SEAP.

        Informatii si formalitati necesare pentru evaluarea respectarii cerintelor mentionate

        1. Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de înregistrare în conditiile legii din tara de rezidenta, din care sa

        reiasa ca operatorul economic este legal constituit, ca nu se afla în niciuna dintre situatiile de anulare a constituirii precum si faptul ca are

        capacitatea profesionala de a realiza activitatile care fac obiectul contractului.

        Modalitate prin care poate fi demonstrata îndeplinirea cerintei: se va completa DUAE de catre operatorii economici participanti la procedura

        de atribuire cu informatiile aferente situatiei lor. Documentele justificative care probeaza îndeplinirea celor asumate prin completarea

        DUAE,respectiv:

        - Certificat constatator emis de ONRC, sau în cazul ofertantilor straini, documente echivalente emise în tara de rezidenta.

        Aviz de functionare emis de Ministerul Sanatatii pentru activitatea de comercializare si distributie pentru produsele ofertate conform Legii 95/2006. conform Legii 95/2006 art 926, republicata si actualizata ,valabil la momentul prezentarii-modalitate de indeplinire- se va completa DUAE

        Persoane Juridice straine.

        Documente care dovedesc o forma apartenenta din punct de vedere profesional, în conformitate cu pevederile legale din tara în care

        candidatul/ofertantul este rezident. Documentele se vor prezenta insotite de traducerea autorizata a acestora in limba romana, semnatura si

        stampila conform cu originalul. Daca exista asociati documentele solicitate vor fi depuse si de catre acestia pentru partea pe care o

        realizeaza.

        Documentele urmeaza sa fie prezentate, la solicitarea autoritatii contractante, doar de catre ofertantii clasati pe primele trei locuri în clasamentul

        Se solicita completarea DUAE. Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE: Lista principalelor produse livrate cel mult in ultimii 3 ani,(2020,2021,2022) cu indicarea valorilor, datelor si beneficiarilor publici sau privati; cel putin un certificat/document emis sau contrasemnat de catre o autoritate ori de clientul beneficiar (recomandari,documente constatatoare referitoare la indeplinirea obligatiilor contractuale sau echivalente), din care sa reiasa indeplinirea corespunzatoare a contractului. La finalizarea evaluarii ofertelor, documentele de mai sus vor fi prezentate la solicitarea autoritatii contractante doar de ofertantii clasati pe primele 3 locuri in clasamentul intermediar.
