        Ofertantii, terti sustinatori si subcontractantii nu trebuie sa se regaseasca in situatiile prevazute de art 164,165,167 din Legea nr 98/2016.

        Modalitatea de indeplinire: Ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca in situatiile prevazute la art.59-60 din legea 98/2016, repectiv se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor.Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza sa fie prezentate, la solicitarea A.C., doar de catre ofertantul pe locul I in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.

        Document obligatoriu:

        Documentele justificative care probeaza îndeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul I în clasamentul intermediar întocmit la finalizarea evaluarii ofertelor.

        Aceste documente justificative pot fi:

        1.• certificate constatatoare privind lipsa datoriilor RESTANTE cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat (buget local, buget de stat etc.) la momentul prezentarii;

        2.• cazierul judiciar al operatorului economic si al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic, sau a celor ce au putere de reprezentare, de decizie sau de control în cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC / actul constitutiv;

        3.• dupa caz, documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166 alin. (2), art. 167 alin. (2), art. 171 din Legea 98/2016 privind achizitiile publice;

        4.• alte documente edificatoare, dupa caz.

        Pentru persoanele juridice straine:

        Se vor depune documente echivalente emise in tara de rezidenta.

        Cerinta nr 1

        Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de inregistrare in conditiile legii din tara de rezidenta, sa reiasa ca operatorul economic este legal constituit, ca nu se afla in niciuna dintre situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului.Obiectul contractului trebuie sa aiba corespondent in codul CAEN din certificatul constatator emis de ONRC.

        Modalitate prin care poate fi demonstrata îndeplinirea cerintei:

        Se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentele justificative care probeaza îndeplinirea celor asumate prin completarea DUAE, respectiv certificat constatator emis de ONRC, sau în cazul ofertantilor straini, documente echivalente emise în tara de rezidenta, urmeaza sa fie prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul I în clasamentul intermediar întocmit la finalizarea evaluarii ofertelor. Informatiile din certificatul constatator trebuie sa fie REALE/VALIDE LA DATA PREZENTARII ACESTUIA.

        Se va completa DUAE cu informatiile cerute, Certificat constatator emis de ONRC sau in cazul ofertantilor straini, documente echivalente emise in tara rezidenta si urmeaza sa fie prezentate, la solicitarea A.C.,doar de catre ofertantul pe locul I in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.Informatiile din certificatul constatator trebuie sa fie reale/valide la data prezentarii acestuia.

        Cerinta nr. 2

        Operatorii economici ce depun oferta trebuie sa fie atestati pentru exploatari forestiere conform Regulamentului privind organizarea, functionarea si componenta Comisiei de Atestare a operatorilor economici pentru activitatea de exploatare forestiera, precum si criteriile de atestare pentru activitatea de exploatare forestiera, aprobat prin Ordinul Ministrului Mediului, Apelor si Padurilor nr.1106 din 2018.

        Modalitatea de îndeplinire: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor.

        Documentele justificative care probeaza îndeplinirea celor asumate prin completarea DUAE, respectiv:

        Atestat de exploatare forestiera insotit de Anexa cuprinzand situatia autorizarii spre exploatare a volumului de lemn pe picior, eliberat in conformitate cu Regulamentul privind organizarea, functionarea si competenta Comisiei de atestare a operatorilor economici pentru activitatea de exploatare forestiera, precum si criteriile de atestare pentru activitatea de exploatare forestiera, aprobat prin Ordinul Ministrului Mediului, apelor si padurilor nr.1106 din 2018 si Cazier tehnic de exploatare.Documentele trebuie sa fie valabile la data depunerii ofertelor, in copie certificata „conform cu originalul”, se vor prezenta de catre ofertantul clasat pe locul I in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.Atestatul de exploatare tehnica trebuie sa fie completat la zi cu cota de masa lemnoasa exploatata.

        In cazul ofertantilor straini, documente echivalente emise în tara de rezidenta, urmeaza sa fie prezentate numai la solicitarea autoritatii contractante. Informatiile cuprinse in documentele justificative trebuie sa fie reale/valide la data prezentarii acestora.

        Pentru persoane juridice/fizice straine documentele care dovedesc o forma de înregistrare / atestare vor fi prezentate în traducere in limba romana.

      Perioada de valabilitate a ofertelor 3 luni de la termenul limita de depunere a ofertelor.

      Note:

      a) Autoritatea Contractanta are dreptul de a solicita ofertantilor, in circumstante exceptionale, inainte de expirarea perioadei de valabilitate a ofertei, prelungirea acestei perioade.

      b) ofertantul are obligatia de a comunica Autoritatii Contractante daca este sau nu este de acord cu prelungirea perioadei de valabilitate a ofertei.

      c) ofertantul care nu este de acord cu prelungirea perioadei de valabilitate a ofertei se considera ca si-a retras oferta, fara ca acest fapt sa atraga pierderea garantiei de participare.

      - Limba de redactare a ofertei - Romana. Toate certificatele si documentele emise in alta limba decat romana vor fi insotite de traducerea autorizata a acestora in limba romana.

      Documentele justificative care probeaza îndeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul I.

      Cerintele tehnice definite la nivelul anuntului de participare, caietului de sarcini sau altor documente complementare, prin trimiterea standardelor, la un anumit producator, la marci, brevete, tipuri, la o origine sau la o productie/metoda specifica de fabricatie/prestare/executie, vor fi intelese ca fiind insotite de mentiunea ”sau echivalent”

      Solicitarile de clarificari ale potentialilor ofertanti se vor adresa in mod exclusiv in SEAP la Sectiunea ”Intrebari” din cadrul procedurii de atribuire derulate prin mijloace electronice iar raspunsurile la acestea vor fi publicate in SEAP, la Sectiunea ”Documentatie si Clarificari” din cadrul anuntului de participare, autoritatea contractanta urmand sa nu dea curs solicitarilor adresate prin alta modalitate de comunicare decat cea stabilita in conformitate cu prevederile art. 64 alin. (1) din Legea nr. 98/2016 pentru comunicarile ulterioare depunerii ofertelor. Comisia de evaluare va transmite solicitarile de clarificare privind ofertele depuse, in SEAP la Sectiunea “Intrebari”. Operatorii economici vor transmite raspunsurile la clarificari si eventualele documente solicitate pe parcursul evaluarii ofertelor prin intermediul SEAP (Sectiunea “Intrebari”), integral in sectiunea corespunzatoare respectivei solicitari, sub forma unuia sau a mai multor documente/fisiere distincte semnate cu semnatura electronica.

      In cazul in care se constata ca ofertele clasate pe primul loc au preturi egale, in vederea departajarii ofertelor, autoritatea contractanta (prin intermediul SEAP la Sectiunea “Intrebari”) va solicita reofertarea, prin prezentarea unei noi propuneri financiare. Noua propunere financiara va fi depusa doar si numai in urma solicitarii autoritatii contractante.

      Ofertantul va prezenta o declaratie prin care accepta clauzele contractuale cuprinse în modelul de contract din documentatia de atribuire. In situatia în care sunt obiectiuni la proiectul de contract respectiv modificari ale clauzelor contractuale sau adaugarea unor clauze noi,

      eventualele propuneri de modificare/completare/eliminare de clauze contractuale vor fi formulate în scris cu justificari si înaintate cu documentele de calificare. Daca propunerile sunt dezavantajoase pentru autoritatea contractanta aceasta îsi rezerva dreptul de a le respinge informând ofertantul. Daca ofertantul nu renunta la aceste clauze autoritatea contractanta va încadra oferta ca neconforma si o va respinge.

      Pentru accesul la datele de identificare ale participantilor la procedura se va completa DUAE, precum și formularele: Scrisoare de înaintare și Declarație privind datele de identicicare.
