3. Section III
   1. Conditions for participation:
      1. Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers:
         List and brief description of conditions:

         Cerințe referitoare la motivele de excludere

         Ofertantul (Ofertant individual, membru al Asocierii, Subcontractant, Terț Susținător) va face dovada că nu se incadreaza la situatiile prevazute de art. 60, 164, 165, 167 din Legea nr. 98 / 2016.

         Autoritatea contractantă, în conformitate cu art. 169 din Legea nr. 98 / 2016, va exclude un operator economic în orice moment al procedurii de atribuire în care ia la cunoştinţă că Operatorul Economic se află, având în vedere acţiunile sau inacţiunile săvârşite înainte sau în cursul procedurii, în una dintre situaţiile prevăzute la art. 164, 165 şi 167, de natură să atragă excluderea din procedura de atribuire.

         Modalitatea prin care poate fi demonstrata îndeplinirea cerințelor:

         Ca dovadă preliminară pentru verificarea îndeplinirii cerințelor se va prezenta DUAE în conformitate cu prevederile art. 193 alin. (1) din Legea nr. 98 / 2016 completat, iar documentele justificative care probează îndeplinirea celor asumate în DUAE urmează a fi prezentate la solicitarea Autorității Contractante, doar de către ofertantul clasat pe locul I în clasamentul intermediar întocmit la finalizarea evaluării ofertelor.

         Menţiune privind modul de completare DUAE: Ofertanţii au obligaţia de a menţiona în DUAE dacă se regăsesc într-una din situaţiile de excludere şi asociat, să indice dovezile pe care le pot prezenta pentru a-şi demonstra credibilitatea. Pentru o mai bună înţelegere, exemplificăm situaţia documentelor constatatoare: ofertanţii vor avea obligaţia de a menţiona în DUAE toate documentele constatatoare care atestă nerespectarea termenelor contractuale, nerespectarea calităţii / cantităţii şi / sau a tipului de produs / lucrare / serviciu ofertat, nerespectarea condițiilor contractuale obligatorii și specifice şi/sau rezilieri anticipate etc. De asemenea, pentru fiecare document constatator, se va prezenta măsura luată de Ofertant pentru a-şi demonstra credibilitatea şi dovada pe care o poate prezenta în acest sens.

         Nerespectarea acestei obligaţii va duce la solicitarea de clarificări, în conformitate cu art. 171 din Legea nr. 98 / 2016.

         Documentele justificative actualizate considerate adecvate pentru demonstrarea informațiilor incluse în DUAE (răspuns) pe care Operatorul Economic le poate propune Autorității Contractante sunt:

         1. Formularul Declarație privind conflictul de interese completat.

         2. Certificate constatatoare privind plata impozitelor, taxelor sau contribuțiilor la bugetul general consolidat (buget local, buget de stat etc.) valabile la momentul prezentării, pentru sediul principal, iar pentru sediile secundare / punctele de lucru, o declarație pe propria răspundere privind îndeplinirea obligațiilor de plată a impozitelor, taxelor sau contribuțiilor la bugetul general consolidat datorate.

         3.Cazier judiciar pentru Operatorul Economic.

         4.Cazier judiciar al membrilor organului de administrare, de conducere sau de supraveghere al respectivului Operator economic, sau a celor ce au putere de reprezentare, de decizie sau de control în cadrul acestuia, asa cum rezultă din certificatul constatator emis de ONRC / actul constitutiv.

         5. Dupa caz, documente prin care se demonstreaza faptul că Operatorul Economic poate beneficia de derogarile prevăzute la art. 166 alin. (2), art. 167 alin. (2), art. 171 din Legea nr. 98 / 2016 privind achizițiile publice.

         6. Orice documente echivalente emise de autoritățile competente din țara în care este stabilit Operatorul Economic.

         7. Orice alte documente edificatoare.

         Operatorii Economici vor depune versiuni sau traduceri ale documentelor suport în limba procedurii specificată în secțiunea IV.2.4) a Anunțului de Participare, respectiv în limba română.

         Persoanele cu funcții de decizie sunt:

         Operatorii Economici ce depun oferta (Ofertant individual, membru al Asocierii, Subcontractant) trebuie să dovedească o formă de înregistrare în condițiile legii din țara de rezidență, din care să reiasă că Operatorul Economic este legal constituit, că nu se află în niciuna dintre situațiile de anulare a constituirii precum si faptul că are capacitatea profesională de a realiza activitățile care fac obiectul acordului-cadru.
