    1. Conditions for participation:

        Ofertantii, nu trebuie sa se regaseasca în situatiile prevazute la Art. 59, 60, 164, 165 şi 167 din Legea nr. 98/2016 privind achizitiile publice.

        Cerinta 1 – Informatii privind neincadrarea in prevederile art. 164, art. 165 si art. 167 din Legea nr. 98/2016 privind achizitiile publice.

        Modalitate de indeplinire prin care poate fi demonstrata indeplinirea cerintei:

        - se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor.

        Cerinta 2 – Informatii privind neincadrarea in prevederile Art. 59 si 60 din Legea nr. 98/2016 privind achizitiile publice. Persoane cu functii de decizie in cadrul autoritatii contractante implicate in procedura de atribuire: Prof. Univ. Dr. Catalin -Florin Cirstoiu – Manager; Ec.         Modalitate de indeplinire prin care poate fi demonstrata indeplinirea cerintei:

        - se va prezenta odata cu DUAE o declaratie pe propria raspundere conform modelului atasat in SEAP.

        Documentele justificative necesare pentru confirmarea cerintelor, vor fi solicitate de catre autoritatea contractanta doar ofertantului clasat pe primul loc in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor, acestea fiind urmatoarele:

        - certificate constatatoare privind lipsa datoriilor RESTANTE cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat (buget local, buget de stat, etc.) la momentul prezentarii (art.196 din Legea 98/2016) ;

        - operatorii clasati pe primele 3 locuri dupa aplicarea criteriului de atribuire, prezinta pentru sediul principal documente din care sa reiasa neincadrarea in prevederile art. 165 cf Legii 98/2016, iar pentru sediile secundare/puncte de lucru, o declaratie pe propie raspundere privind indeplinirea obligatiilor de plata a impozitelor, taxelor sau contributiilor la bugetul general consolidat datorate;

        - cazierul judiciar al ofertantilor (operatorilor economici);

        - cazierul judiciar al membrilor organului de administrare, de conducere sau de supraveghere al respectivului ofertant, sau a celor ce au putere de reprezentare, de decizie sau de control în cadrul acestuia, așa cum rezultă din certificatul constatator emis de ONRC / actul constitutiv;

        - dupa caz, documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166 alin. (2), art. 167 alin. (2) si art. 171 din Legea 98/2016 privind achizitiile publice;

        În cazul operatorilor economici straini se vor prezenta documente echivalente si edificatoare emise în conformitate cu legislatia tarii de origine (certificate fiscal, certificate judiciare, etc.) care sa confirme faptul ca sunt indeplinite cerintele in tara de rezidenta. Toate documentele solicitate trebuie sa fi valabile la data depunerii acestora.

        Cerinta 1 - Operatorii economici care depun oferta trebuie sa dovedeasca o forma de înregistrare în conditiile legii din tara de rezidenta, ca sunt legal constituiti, ca nu se afla în niciuna dintre situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului. Modalitatea prin care poate fi demonstrata îndeplinirea cerintei: se va completa DUAE de catre operatorii economici (lider, asociat, tert sustinator,-daca este cazul) participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentul justificativ care probeaza îndeplinirea celor asumate prin completarea DUAE este certificatul constatator emis de ONRC, sau în cazul ofertantilor straini, documente echivalente emise în tara de rezidenta. Înainte de atribuirea acordului cadru, autoritatea contractanta va solicita operatorilor economici (lider, asociat, tert sustinator, daca este cazul) clasati pe primele 3 locuri dupa aplicarea criteriului de atribuire sa prezinte documente justificative in original sau copie certificata pe proprie raspundere pentru conformitate cu originalul, prin care sa demonstreze îndeplinirea criteriilor de calificare, în conformitate cu informatiile cuprinse în DUAE. Toate documentele justificative prezentate trebuie sa fie valabile la data depunerii acestora.

        Cerinta 2 - Operatorii economici care depun oferta trebuie sa dețina Aviz de funcționare emis de ANMDM în conformitate cu Legea 95/2006 republicată, cu modificările și completările ulterioare și OMS 1008/2016 pentru tipurile de activități prestate în domeniul dispozitivelor medicale (potrivit Art. 926 (1) din Legea 95/2006 – după caz), aviz în care trebuie să se regăsească producătorul dispozitivelor medicale care fac obiectul achiziției. Modalitatea prin care poate fi demonstrata îndeplinirea cerintei: Se va completa DUAE de catre operatorii economici (lider, asociat, subcontractant-daca este cazul) participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentul justificativ care probeaza indeplinirea celor asumate prin completarea DUAE este Avizul de funcționare emis de ANMDM.

      Cerintele tehnice definite la nivelul anuntului de participare, caietului de sarcini sau altor documente complementare, prin trimiterea standardelor, la un anumit producator, la marci, brevete, tipuri, la o origine sau la o productie/metoda specifica de fabricatie/prestare/executie, vor fi intelese ca fiind insotite de mentiunea ”sau echivalent.

      În cazul în care două sau mai multe oferte au o valoare totală egală a propunerii financiare şi sunt clasate pe acelaşi loc, în vederea departajării, autoritatea contractantă va solicita noi propuneri financiare. În cazul în care și după depunerea de noi propuneri financiare egalitatea se menține, autoritatea contractantă va încheia acordul-cadru cu toţi operatorii economici clasaţi pe locurile aferente numărului maxim stabilit în anunţul de participare (primele 3 locuri). Oferta (inclusiv documentele/anexele acesteia) incarcata in SICAP fara semnatura digitala va fi declarata inacceptabila si descalificata in conditiile art.137 alin.2 lit j) din HG 395/2016.
